is the sks legal to own?

I own an sks type 56 paratrooper. I read articles that it is illegal to own because it uses ak-47 magazines, but another article says it's ok to own if you use 5 round magazaine. Another article says it is illegal if it has a detachable magazine and not a fixed magazine. It also says it is illegal to have it if it has a bayonet. My sks does not have a bayonet, but it does have a bayonet lug. This lug also is illegal to own says the article. My sks has a monte carlo stock. I want to use it for hunting. Can anyone help me? Is it illegal or legal to own an sks that uses ak-47 magazines? Thanks.

    In California it would be illegal. It would probably depend on the state you live in. Sorry, no help here.

    For hunting, depending again on state, most states limit the rounds in the magazine to no more than 10, some 5 or less. Also depends sometimes if it is big game (deer, ect) or if it is considered varmint,vermin, ect.

    It would probably help to know what city you're in, I believe NYC and NY state have some different laws. If you are in NYC

    "New York City forbids the possession of an ``assault weapon,'' which includes various specified semi-automatic rifles and shotguns, or revolving shotgun. It is also unlawful to possess an ``ammunition feeding device'' capable of holding more than 17 rounds in a handgun, and more than 5 rounds in a rifle or shotgun. "

    What do you want to hunt with it? Varmint, knock them dead, it will do well. Deer size game, you had better be planning to be real up close and personal. The 7.62x39 like the .223 was not designed to kill as much as to maim man sized targets. For say a good size whitetail there are a lot of cartridges that I would perfer over the 7.62x39 with any combination of slug and powder.

    Every municipality in NY can have its own gun laws (your firearm laws are not uniform throughout the state)--you would do best to get your answer from a very local source, the best would be an answer from a local attorney familiar with the firearm laws.

    As far as the killing power for deer sized game goes,I gave one to a friend.In the last 5 yrs he has shot 4 deer and never had to track a wounded one.All he uses is the cheap Russian hollow point ammo.

    contact your local sheriffs dept they can ansewer you. laws vary by county in ny

    You need to contact your your Chief Law Enforment Officer, which is going to be most likely your chief of police, not sherriff, but it may be the sheriff, what city/town/municipality are you in?

    They will send you a form (might be one online) to start the process.

    If you were in Western NY, say Erie county, its completely different. Most rifles are legal in NYS with no permits, even assault rifles that were made pre-ban (1994 Clinton ban). It is the same restriction as exists country-wide, but NYS put an essentially non-reversable no time limit law for the state that equals the federal ban that will NOT go away even if the fed bad sunsets. Pistols are a different story and the gestapo treatment of Pistols by NYC politicians covers the whole state.

    But your gun would be perfectly legal in the other 90+% of NYS that is not Westchester County and the 5 bouroughs.

    Basically NYS gets to its rural and free roots from Syracuse and west. NYC should really be its own District sepearate from the rest of NYS, lime DC, it fits in with the rest of the state like LA would fit in the middle of Kansas. My 2 cents.

    You want to go to amazon or somewhere and get a copy of "Firearms and Weapons Laws - Gun Control in New York" published by Looseleak Law Publications, Inc.

    It has step by step guides on how to obtain the various gun permits you need in NYS and NYC for pistols and for Westchester county stuff.

    Or you could get in your car and drive west for and hour or two and relocate!
