ithaca (auto & burglar). iver (hercules)
I am inquiring on two firearms that i have aquired through my granfathers passing . one is a Ithaca Auto & Burglar 20ga with a 10 1/4" barrel ser#3904XX and the other is a Iver Johnson Hercules .410 with a 10" barrel ser#26XXE i know the law states that the barrel has to be over 18 1/2" to be legal but i thought that if it was made before the law went into effect and was made at the factory with that barrel lengt that it was ok i am looking for knowledge into what is rigth and what is wrong. the ithaca is missing the fore guard and was wonderign where i might be able to get a replace ment for it.

BOTH GUNS , IF NOT REGISTERED WITH BATFE, ARE A NONO. LOTS OF TROUBLE IF YOU ARE FOUND WITH THEM. NO LEGAL WAY FOR YOU TO HAVE THESE GUNS.

Both of your shotguns would have to have been registered during the amnesty in December 1968, to be legal. If they weren't, there's no way to retroactively register them.
Perhaps your Grandfather did register them. If you can find the papers, or make inquiries to your relatives to see if they are knowledgable about this matter?
If they were registered and in factory original condition, they would have substantial value to collectors.

The guns would have to be dewatted to ATF specifications, which would pretty much destroy the gun. The owners status as law enforcement makes no difference.
Bottom line is that if the guns HAVE been registered pursuant to the National Firearms Act they MAY be legal for you to own but you will have to jump through some hoops to get them transferred to you. If the guns are NOT registered under NFA they are contraband, period.

Shootersrealm, if you are a LEO there is a way for you to legally possess these firearms. Please note that I said possess not own. If your local CLEO is ok with it you can give the guns to the dept. and they can register them on a form 10. Once they are registered with your dept. then they can issue the guns to you. The catch is a major one, once a gun has been put on a form 10 it can never be removed from a form ten meaning that it can only be transfered to other LE agencies, upon your retirement or leaving that job you would have to return the guns to the dept. There is one other way to make the Ithaca legal. Have a gunsmith thread it for a 20 ga screw in rifled choke. If he puts it in so that it can not be removed, you now own a legal 20 ga rifled pistol. Until he gets it done, be sure to sell the receiver to a trusted friend for a $1 and buy it back from him when the barrel is done. A few years back I saw a Howdah pistol that had paradox rifling which is in essense the same thing. 0 -
