C&R holders and NFA arms

OK, I learned this spring that there are C&R eligible NFA arms out there. My dealer that has transfered my previous purchases has only owned one of them. The others came from GB and he handled the transaction. He doesn't have to pay $200. to have them in inventory. My question is that if I were to buy a C&R eligible full auto could I keep it without paying for the $200. stamp? Naturally, I couldn't sell it without the purchaser applying to the BATF.

    If you are a C&R licensee, you can obtain a C&R NFA weapon directly from any FFL or nonlicensee within the US. You don't have to pay a local dealer to handle the transaction for you.

    However, all NFA rules apply, including payment of the $200 transfer tax. BATFE & local LEA chief approval must also be obtained.

    Well I thought this was too good to be true! Neal, I'm speaking of only class 3 items here. Maybe where I went wrong was that my dealer pal happens to be a dealer that can handle NFA arms. Am I correct that if a dealer does not have that option, any full auto he takes in (even for immediate resale) has to be transferred to him with the $200 fee? I'm sure my pal doesn't pay $200. for NFA items on hand. So having a C&R and buying a C&R eligible NFA item doesn't save me anything. Sometimes I think reading all these rules are like reading the phone book!

    Jeff, only a Class III dealer can handle Class III weapons. However, the way that the weapon is "titled" determines whether or not he has to pay a transfer tax when he acquires it. This can get complicated, & I defer to Mark Christian for any further explanation.

    Of course, with the cheapest C&R machine gun starting in the thousands, an extra $200 or so doesn't really seem that significant to me.

    Good point about the $200. Neal - just change! I shouldn't bother thinking about this. I can't afford to re-buy what I already have - and I've only had them about 4 years. Wish I had bought 50 back then. How many hundred of us have said the same or similar things. Amazing how good hindsite is!

    Even with a C&R Weapon, you have to pay the $200. Yes, you can have it transferred directly to you, without going through the C3 dealer.
