    Curio and Relics Licensees cannot deal in firearms. You will need to get a regular FFL to do the transfer. You would be breaking the law if you had the gun shipped to a C&R and then bought it from him.
    Also, is this one of those marbles pistols that is considered an AOW? IF the 410 barrel is smooth and not rifled, you will need to go through a Class 3 dealer in your state.

    Jess, yes it is a smooth bore, 10" barrel, the atf told me that it had to go through a curio and relics dealer is why I asked for one, but they seem to change there minds weekly about this gun. What is a class 3 dealer and do you know one in mi. Thank You, Skeeter

    I know of at least one class 3 dealer in MI, he probably knows of others. Where in the state are you?

    The Marble's Game Getter in the configuration you describe is still considered a 'firearm' under the provision of the National Firearms Act. A licensed collector (C&R) could acquire one in interstate commerce without going through a FFL dealer/SOT, but the collector would still have to file the appropriate forms and pay the appropriate tax.

    As an individual, you will need to find a dealer who has paid the Special Occupational Tax to deal in firearms under the National Firearms Act (short-barrelled shotguns, machineguns, etc.). This is known as a 'Class 3' dealer, although that is really nothing more than a Type 01 FFL dealer that has paid the Class 03 SOT. You will be required to fill out special ATF forms, submit fingerprint cards and photographs, obtain a signature from the chief law enforcement officer of your area certifying that there is no reason to prohibit you from owning this firearm, and submit a $5 tax payment (assuming the original stock is present; if not, it is a $200 tax). All that is submitted to the ATF for approval, and in a few months you will receive the form back with a tax stamp attached.

    Now, all this is assuming the firearm in question has already been registered under the National Firearms Act of 1934 - either originally upon passage of the act or in the amnesty period. If not, the gun is contraband and cannot now be legally registered, possessed or sold.

    Thank You all for your information, yes the gun was registered during the amnesty period in the sixties, it is a legal gun, but is registered to guy who now lives in florida, that is where the big problem lies, getting the papers for it back to michigan. No it does not have the stock for it,I would like to find one if I ever get the gun. Can some one tell me where and how to contact a class 3 FFL dealer who will help me out? Thank You skeeter-a

    Skeeter, As far as I know, Class III firearms are not legal in Michigan for individual ownership. If you were a class III dealer or Class II manufacturer, then you could own one. THeir will be no way for you to legally own this gun. If you are willing to move to the left a little bit, Wisconsin allows all of the Class III stuff, and we can always use another shooter over here.

    Actualy Michigan operates under a "catch 22", the Fed's won't approve a class 3 liscense until the state says it's OK, and MI won't say it's OK until the Feds say it is.
    If you have a class 3 that was issued elsewhere, than MI will give it's approvial. There are a couple of other ways to get one also, but I'm even less familier with the details.

    Skeeter, let your fingers do the walking, IE: call a few gunsmiths and ask if they are or know of a class 3 dealer that will help you out. I've already given you one big hint, but as his wife has been sick lately, I won't post his name or phone #.
