A little help
I picked this up at a gun show, and the guy told me it was a muzzle break, and therefore legal to put on the end of my post ban colt, but I have my concerns and don't feel like going to jail for a 5 dollar item. thoughts and opinions would be great...

That is an A2 flash hidder for an M16/AR-15 rifle. The earlier A1 version did not have the solid portion which is intended to limit the dust kicked up when firing as well as act as a muzzel brake in addition to a flash hidder. Although this particular unit has a hole drilled for a set-screw attachment to a post ban rifle, it is not legal and would be considered a flash hidder by the BATFE. As a general rule of thumb any muzzel device which has vertical slots is going to run the risk of being considered a flash hidder, while those with horizontal slots or round holes are generally considered muzzel brakes.

Nearly all of the big firms like Bushmaster, Panther Arms, and Rock River, as well as the usual parts suppliers (J&T Sales, Model 1 Sales, ect.) offer a wide variety of muzzel attachments for postban AR rifles to provide pretty much whatever look you are searching for.

Actually the 3 prong A1 version is a better flash supressor. The A2 was developed to aleaviate the habit of the A1 snagging vines in Vietnam jungles. The early A2's had the cuts 360 degrees while the later ones had the dubious 270 degree "muzzle brake"

Of course you are correct skyking! The A1 birdcage was actually post-production change #9 and was approved in September 1966 and adopted in January 1967. This was the third type of flash suppressor used on the AR-15 since the rights were purchased by Colt and production of the Colt Model 601 began with the first two types being the three prong style as you described. The later A2 flash suppressor actually originated as a Canadian design and was on included on the Product Improved M16A2 when it was adopted in November 1983. I can't beleive my over sight!

Ok, but wouldn't the muzzle break have to be permanently attached to the post ban barrel, and not screwed on as this one could be?

Neither one is screwed on. Notice how special mention is made of OD of the barrel? It slips on and is secured by the setscrews. Usually a slight depression in the barrel aids retention.
The device on ebay probably more fits the definition muzzle brake than the birdcage flash suppressor.
In a few months it might not matter much anyway. [:D]

true, but I don't hold much hope for the AWB not being renewed, there would be too much negative PR for it, esp during an election year.
The one I originally had questions about uses 2 set screws to hold it in place, the one on ebay also uses them as you mentioned. Basically what I'm asking is, were I to sell this item on the market, or take it to the range, would it be legal to do so using either of these at the end of the barrel?0
