Yugo SKS Legal Questions

There seems to be a lot of gray areas on what one can and what one cannot ad, modify, or remove from the Yugo SKS and still be legal.
So, I thought I would pose two of my questions to the Experts:

    1. Is it legal to replace the fixed 10 round magazine with a fixed
20 round magazine on the Yugo SKS?

    2. Is it legal to install an aftermarket MonteCarlo stock on a Yugo
SKS and if so, is it legal with a fixed 20 round magazine?

These questions are in reference to a Yugo SKS retaining all it's original features as issued (bayonet, grenade sight, etc.)except for those being replaced. Have been getting all kinds of conflicting answers.

    Thanks.

I didnt know they had a fixed 20 round mag. But if you are refering to the detachable mag then this is the way I understand it.
1> No you can not add the mag with the bayonet and grenade launcher still attached
2> I read somewhere that altering the yugo in any way technically made it illegal but I dont know that for sure. If it is not correct then the stock I beleive is legal but not the mag. Refer to answer #1

I see no problem in either of the modifications. As long as you don't add a detachable magazine, you will not be creating an illegal "semiautomatic assault weapon".

Of course, I don't understand why you would want to do either modification. Even with a scope mounted, you don't need a monte carlo stock (the SKS is not a precision target rifle). The 20 round mag is unnecessary, as stripper clips make reloading the standard 10 round mag quick & easy; the long 20 round mag just makes the rifle unwieldly & heavier than it already is.

The SKS stock is too short for me and the MonteCarlo style aftermarket stock fit me well as opposed to adding extra thick recoil pads. A lot of folks say that the MonteCarlo is classified as a pistol grip stock, thus illegal with the Yugo's stock issue evil features.

There is a "stock" 20 round fixed SKS magazine which is about an inch or two longer than the 10 round fixed magazine. Fits and works fine in the Yugo without impairing handling charateristics. The fixed 20 round magazine just gives the advantage of an extra 10 inital rounds before reloading with stripper clips.

Would like to put these items on my Yugo shooter permanently but don't want to get a knock on the door in the middle of the night either.

ATF regs list a fixed mag with capacity of more than 10 rds as being an evil feature too[xx(]

Anything that alters its "original military configuration" removes its C&R status.

The info that I got from the NLC in Atlanta was that, if you change one thing, you have to change them all. That means remove the grenade launcher, bayonet, and night sights. Then there has to be at least ten American-made parts installed.

Gunpaq - quote:There seems to be a lot of gray areas on what one can and what one cannot ad, modify, or remove from the Yugo SKS and still be legal. There's an understatement.

How about some practical experience. The Monte Carlo stock fits, but it's a snug fit. Kingjoey had to squeeze the he!! out of mine to pop the trigger group back in when reassembling (I'm lazy and use a rubber mallet).

No, it's not classified pistol grip. Maybe you're thinking of the Dragunov style.....? That one may have been reclassified as pistol grip, check with ATF.

The two sections to keep in mind are 18 USC 922(r) and 922(v). Here's a pretty good link:

    http://www.geocities.com/Yosemite/Gorge/4653/bardsks.htm

Notice that keeping the mag fixed keeps the SKS under the radar (Kingjoey, where'd you hear that about the fixed mag?).

    Good luck.

Got a new gun for my ex-wife.....pretty good trade, huh?

holy crap. your link has a letter from the atf saying it's illegal to put a bipod on an sks...I quit reading after that!

Make your Yugo exempt from the 'assault weapon' ban. Have the rifling removed from the barrel....make sure the barrel length is atleast 18.5"..........whalla....shotgun, no longer a rifle.

Gun Control Act of 1968, Title 18 US Code, Chapter 44:

defines a rifle as having a rifled bore. (Might have to make such a weapon from scratch to comply tho...ATF could claim it was sold as a rifle and still considered one, although it no longer meets the Federal definition.)

defines a 'semi-automatic assault weapon' as....yada yada yada..
    (D) a semiautomatic shotgun that has atleast 2 of-
    (i) a folding or telescopic stock: (your's wouldn't)
(ii) a pistol grip that protrudes conspicuously beneath the action of the weapon; (monte carlo stock does not have a grip like an AR15)
(iii) a fixed magazine capacity in excess of 5 rounds and; (you got this one)
(iv) an ability to accept a detachable magazine, (not you)

    I know....I have weird thoughts....

... or ... that any combination of the listed features make it a 'semi-automatic assault weapon'

    ... or ... more than 1 makes it a 'semi-automatic assault weapon'

There are so many ways they could have said it clearer [:(!]

Do a google search on the sks and you will find plenty of info on legality issues. My understanding is combinations of more than 2 assult type items on the gun make it a baned wepon, double check but i think even having a bayonet mount without the blade counts. I have a 1954 tula russian with bayonet that's never been fired and did some research a while back, started to get scared that it was illegal but after reading some found out it was ok in stock platform. check with nra if confused over government legaleze talk. good luck.
