You need a lawyer familiar with gun law.

By you nickname I take it you are in Georgia. Who is this pawn shop so I can be sure to avoid them. I have used two different dealers to do FFL transfer and have had NO problems.

    Good luck

The pawn shop is Ed's Pawn shop in Stockbridge, Georgia. Here is the email that he sent me.
quote:Originally posted by magSir my knee jerk reaction is to not transfer this gun to you..I will send
it back to where it came from and you can make other arrangements. However
you need to be aware of the following:
I am not required to transfer anything to anyone by any law. If I choose to
require more information than I am legally obligated to obtain by federal
and state law that is my prerogative. Gun laws change often and are open to
interpretation. My staff and I attempt to maintain current knowledge of all
regulations and requirements and every request that was made of you was to a
higher standard than was legally required.
As for reporting me to ATF please forward them a copy of this message. I
previously worked for local law enforcement and have not seen many of those
agents in years. I would love for them to come by and see me so as to
    re-kindle old friendships.
As for transferring firearms you are the straw that broke the camels back. I
sent a notice to gunbroker.com that I will no longer handle transfers
    effective immediately.
Now if you think that we are trying to give you a hard time or not up on the
laws that is your opinion. Your gun is here and I received the information
that I needed to log it into my computer base and log it out to you. This is
a handgun and you will be required to have a GEORGIA DRIVERS LICENSE and a
STATE FIREARMS LICENSE or pass a BACKGROUND CHECK. THERE WILL BE NO
EXCEPTIONS. You will not talk to any of my staff only to me and when I am
able to handle this transfer personally. You need to make an appointment or
this guns going back.....I truly hope that this is some kind of
mis-communication because I hate to lose good customers....Ed

    (1) I would have it shipped back to the seller (2) Have the seller take it to a reputable dealer. (3) Have that dealer send it to a different dealer (other than the pawn shop) All this is probably gonna cost you about 30 - 50 dollars more for piece of mind. Had the same trouble and waited 4 months for the Di$khead I thought could do it for me. Went to a store I never been in and it took 6 days from start to finish. Good luck.

I will gladfully do the background check if given the opportunity to do so. I contacted him yesterday and asked when could I fill out paperwork and he started asking questions about if I was active duty military. Basically giving me the run around. What the hell does being active duty military have to do with a FFL transfer? I have the Georgia Identification and required paperwork. What more do I need? I didn't know that I had to be in the Military to purchase a gun. quote:Originally posted by MIKE WISKEY

It sure seems that Ed's is neither a small nor a new operation from information gathered with a web search. My question is, why on earth did they not do a background check on you prior to forwarding their FFL for shipment of your handgun? If I were you I would camp out at his store until he got HIS mess cleared up; that is, providing I had all of my ducks in a row.

I truly feel that his staff was unsure of what procedure to follow. The young lady I talked to first, didn't know what procedure to follow and the next guy was pretty unsure. Now Ed is pissed off that I questioned their knowledge of current gun laws. He said he does not want me talking to any other memebers of his staff. Basically admit your mistakes and follow through with your agreement to act as a FFL, is what I am asking ED and his staff. I assure you that the background check is not a problem, I have passed at least six over the past two years. I had to pass two to get my teachers certificate in Alabama and Georgia. Ed is basically being an A$$. But he fails to realize that He is building that pretty new building in Stockbridge and it is being paid for by customers money and business. quote:Originally posted by Ronald J. Snow

If you have done everything right and since he said to send a copy of his email to the BATF do it. Dont tell him you did. Also inform him to send it back to where it came first. Since the guy who sold it is not an ffl when he receives it have him contact the BATF and turn the guy in for shipping a gun to a non FFL holder.

Since the object is to get the gun in your hand, I would probably sweet talk him and do what was necessary to accomplish that goal. Then I would never do business there again and try to make sure none of my friends did either.

I think that the funniest part is telling me that I need to make an appointment to come in and fill out the background check paperwork. An appointment to go into a pawnshop and fill out the background paperwork and also that I can't talk to anyone else (his staff) in the store. He used to be a Henry County police officer and feels that he is still on the force.quote:Originally posted by reb8600
