Not familiar w/ AZ requirements, but since it is a state w/ many part year residents they may have a provision. The shop selling you the pistol should know ...

If you only have time to do two things so-so, or one thing well ... do the one thing!

You have a choice.....Either become an Arizona Resident and get the Pistol You want....or Stay a Montana Resident and buy one at a Gun dealer in Montana...you can't have it both ways.....

How about getting an Arizona state-issued ID card, not a DL, to get around this?

As long as you establish residency, you are okay. You may do this with multiple documents. a lease agreement in your name in AZ along with utility bills, car title from AZ, etc. A drivers licence in NOT a requirement for a handgun purchase. You may have some problem with the clerks not knowing what the actual requirements are, but from what you have written, you are good to go IF you can produce those documents.

The law was written to keep gunrunners from going to VA from DC to buy their pistols.

As a last resort, have the clerks call their ATF and check it out. The compliance guys know. Your drivers licence can be used to accertain you are the person on the lease and it can be used on the AZ 4473.

p3 sounds good. I might need this in the long run.
At the least, you can drop $50 on it and put it on law-a-way until the clerks figure out the correct way to document it. We have a a Navy GB'er who will call an unfamiliar FFL to let them know he is coming in for a transfer/whatever, is out-of-state, and with his detatchment orders, there are guidelines the clerks follow, but usually do not know.

There are only 2 specific circumstances under which a citizen who resides in another state can buy a handgun: college students, & military personnel whose quarters are in a state adjacent to the one where their base is located.

No, you don't HAVE to produce a local drivers license. You can produce leases, utility bills, & anything else you can think of to dazzle the dealer, but the bottom line is that few dealers will chance transferring a handgun to someone whose drivers license is from another state. If BATFE revokes your FFL, it is gone, gone, gone; there is no appeal, no recourse, no second chance. Who would blame a dealer for not wanting to take a chance?

    Neal,
There is no distintion between full time and part time resident, only that the person be a resident (90 days is the minimum for dual residency).

Think about it. The clause for military and college students extends no extra privlege or coveys special exemption. They don't have lease agreements or utility bills (barracks, dorm), but they are residents of their perspective states where their base or college is.

Check your pubs, no violations here.
Not all dealers sit down with ATF over coffee and discuss things, but I do. That's why I've never been cited for any operating errors.

I'd agree with Nunn on this one. As long as you have an address there and have a state ID, there should be no problem. Hell, even CA accepted state ID's!

To make life easy on everyone, here it is, chapter and verse:

    REF: ATF P 5300.4 (01-00)
    Page 136 (B13)
    (quote)
"May a person who resides in one State and owns property in another State purchase a handgun in either State?

If a person maintains a home in 2 States and resides in both States for certain periods of the year, he or she may, during the period of time the person actually resides in a particular State, purchase a hnadgun in that State. But simply owning property in another State does not qualify the person to purchase a handgun in that State"(unquote)

(B12) The paragraph above this one talks the 90 day requirement for military and aliens purchasing firearms.

This is the section one would need to reference to a dealer in AZ. He WILL have this publication available.

In this part of the country we have resident aliens and snowbirds in condo's for 4 to 6 months. I've sold weapons to both groups with ATF's blessing (none were ragheads except a Saudi who drinks Budweiser and chews Redman, he's become a "Good ole boy" and married a local girl).

    Good luck!

Nunn's answer works. I'm a PA resident but was stationed in TX. I got a Texas State ID that looks like a driver's license but is just an ID. Was able to buy guns with that no problem. - Toe

I overheard some people talking in a local gunshop that an AZ fishing License would work, assuming I heard correctly. This was brought up because a guy interested in purchasing a gun had the incorect address on his DL, and asked if he could get around this without going to the DMV.

The ID card (being a state issued picture ID) would work IF it list a physical address, not just a PO Box or "General Delivery"

Residency MUST be established and if a dealer took a ID that did not do that, he would be in technical violation of the law and the sale would be invalid. Once again, this is something not everyone is aware of.

My understanding is that every firearms transaction thru an FFL holder must be run thru the BATFE instant check (BRADY). The dealer takes the information for the form 4473 from the buyers State Drivers Lic. and phones it into the BATFE. If their check reveals any discrepancies they will put a hold on the sale or deny it.

I have been looking for a vacation home in Arizona for some time.
I have asked the same question of several dealers. They have told me they will accept an ID card with a local address from the DMV.
The Arizona DMV told me I cannot have driver's licenses from both states but they will issue an ID card if you have a local residence.
