pistols not requiring a permit to buy?

    Made before 1898? I believe...there is a list printed by the ATF that lists all the C&R/Antique mfg/models of firearms you can purchase without a license.

    Let's not confuse "permit" with "background check". There is a huge difference.

    The BATF list is only of C&R firearms, not antiques. Even then, not all C&R firearms are listed. While an antique firearm, made prior to 1899, is not regulated at the Federal level, C&R firearms still are regulated. A C&R FFL can be used to receive C&R firearms without going through a dealer.

    It depends upon where you live.

    In some localities ALL pistols, including antiques, may require a permit to purchase. Local law takes precedence over federal law when it comes to firearms.

    Then there are Black Powder pistols that like antiques (pre-1899) are subject to local laws .... but require no NICS/4473 activity.

    Know your local laws, and if your unsure inquire at a local gun shop.



    If you only have time to do two things so-so, or one thing well ... do the one thing!

    All guns made before 1899 are antiques. If the gun was made in 1898 it is an antique and not subject to Federal law.
    It doesn't matter whether it is a muzzleloader, or a single action Colt that you can still buy ammo for at your local gun store, if it was made before 1899 it is an antique.

    I always seem to be suspicious of questions like this, makes me wonder what someone is up to. Just my 2 cents

    People ask because they do not know.....perhaps they are trying to follow the law rather than break it?

    Now, had it been a question like, "how do I convert my post ban AR-15 to full auto" I may not have answered it and perhaps might have tried to convince them not to. His is not such a question.

    If you were going to start wire tapping and locking people up for asking how old a firearm has to be to be considered a C&R or what types of firearms don't require FFL transfers then you may as well lock up half of the board posters.
