    She must comply with the firearms transportation laws of every state that she passes through. And, she must check FL law to be sure that none of the specific guns are prohibited or restricted in FL.

    Transporting guns in FL is not all that bad, she really needs to worry about all the other states she has to drive through. As far as FL is concerned just toss 'em in the trunk, but other states demand more. A GA officer who was writing me a speeding ticket hassled me (just a little bit) over my unloaded 12ga in a zipper case because there was no way to lock it - - but where he pulled me over guys had guns in the rear-window-racks of their trucks. I guess he just wanted me to feel welocome.

    Just to be on the safe side I'd make sure they are unloaded, buy a couple of those cheap plastic hard cases and a couple of cheap pad locks - - lock them in the hard cases and lock them trunk.

    And if stopped, do not give the police permission to open the trunk or locked gun cases. Might get hassled, but you'll keep your stuff.

    You are protected by federal law when transporting firearms. As long as you can prove the gun is legally owned in the state you start from (in her case an FOID) and is legal at your destination you can pass through any state with inpunity. There are a few provisos You can not stay overnight in any state where possession is illegal. For many years I would drive from WI to FL. I would have to time the trip so that I did not have to stay over night in TN which requires a permit. If she has a car the gun must be unloaded and in the truck. If an SUV, it must be unloaded and in a locked case. When FL passed its CCW law that completely solved the problem since TN affords recprocity. Your sister would be smart to get a FL CCW permit. She does not have to be a FL resident to get it.

    O.k. I think I'm getting it. 410 Stevens dble bbl., 22 colt revolver, commemorative colt 1911 45. Nothing at all here complicated the way I see it. All guns were my fathers and he recently passed away. She lives in Florida (17 years). Locked cases and in the back of an SUV should not pose any problem the way I see it. Am I wrong? Thanks for all the help.

    Florida state statutes are found at http://www.leg.state.fl.us/Statutes/

    The FHP (Florida Highway Patrol) and county mounties are generally well versed in the statutes. The local yokals in small town speed traps generally tend not to know about the statutes. A printout of the sections pertaining to transportation of firearms, tends to change their outlook, when you are a Florida resident and may show up in court.

    If they are are going to be driving a "SUV", they need to put a blanket over the "lock-boxes" when they stop for a bite to eat. There are plenty places when less-than-desirables prowl around looking in the back of "SUV's" and will smash out the rear window --- grab and be gone in seconds, if they see anything that looks worth taking.

    First of all Tn. does NOT require a 'permit' (only if you are to 'carry' a gun "loaded"?)? & and what the hell is a "permot"????
    Before you go & give 'advice' on a subject , please knoow what YOU are talking about !!!! Believe me , Ive been a LEO for 24 years ...
    Get it right guys !!! Unless its an illegal firearm (sawed off shotgun)ect. or you have a 'loaded' firearm in your posession , NO
    PROBLEMS !!! & Yes DO Get a FLA. 'carry' Permit...Ive even got one (& dont 'need it').....

    I would not be so quick there,pard. There's alot of real estate between IL and FL. I also happen to know for a fact that NY has no peaceful journey provision with no exception for LE either. Last check they did not issue ANY non-res license. So if you are a LEO on a trip you have no protection outside professional courtesy.

    Last time I checked , N.Y. was not between Illinois and Tennessee , they must have moved it last nite??? As I stated before , get your facts right , Tn does NOT require a 'permit' to own a firearm , just to 'carry' ...and yes as per fed. law , one may transport personal firearms from state to state , as long as it is a legal firearm and done so in a legal manner...of course if one was to take the 'long' trip from Il. to Tn. and go thru NY???, then you may consider the facts that it is almost as anti-gun of a commie state as Kalf. and you may encounter firearm prolems ...as far as the 'trip' from Il,
    to Tn. , every stste in a direct route thereof is reasonable as per their firearm laws and police policys...I am speaking from experience!
    I once resided (& was a LEO) in Il. and now live in Tn. (as a LEO),
    So "Pard", get it right !!!& I will ak again "what is a permot"???
    and by the way , some-one elses (dad) foid is useless for you !!!!!

    I realize it is hard to get to TN thru NY.Point was this, without knowing the laws of the states you will travel, it is foolish to risk becoming a felon over based on the advice of a few "trusted" people. Regardless of how reliable I have found the info to be.
    The FOPA I do not believe covers handguns (am I mistaken? I will check)but this does not change the fact that transporting these guns thru NY (i.e. 1911 and .22 revolver) EVEN AS A LEO will make you a felon. If caught....

    EDIT 1500hrs- I may stand corrected on that FOPA- It does not specify which firearms. It also specifically says that it precludes state laws for transport. I also know that if check a pistol at the airport as a non-res in NY they will have you arrested. Outcome of cases? Still more research to go.

    Interstate Transportation of Firearms

    Notwithstanding any other provision of any law or any rule or regulation of a State or any political subdivision thereof, any person who is not otherwise prohibited by this chapter from transporting, shipping, or receiving a firearm shall be entitled to transport a firearm for any lawful purpose from any place where he may lawfully possess and carry such firearm to any other place where he may lawfully possess and carry such firearm if, during such transportation the firearm is unloaded, and neither the firearm nor any ammunition being transported is readily accessible or is directly accessible from the passenger compartment of such transporting vehicle: Provided, That in the case of a vehicle without a compartment separate from the driver's compartment the firearm or ammunition shall be contained in a locked container other than the glove compartment or console.

    BTW, not only was I a peace officer in California starting in 1963, I taught in the Criminal Science department of the University of Wisconsin, Platteville. About 65% of the law enforcement officers in Wisconsin come from that program. In regards to Tennessee, I don't know how long you have resided or worked there, but until they passed their must issue law, a permit was required to have a handgun in your car. The court decisions based on the "safe passage" law all seem to indicate you can not stay over night in any state where possession is illegal. You describe NY as a "Commie state" which I take it to mean you think it is anti-gun. You were a LEO in Illinois. That is a state that make no provision at all for concealed carry for its citizens. NY happens to be one of the easiest non-must issue state in which to get a CCW. As you can see I've corrected the typo that seemed to greatly offend you. What the h*ll is knoow?

    Yes, because you have to be in legal posession at the beginning and end of your trip. You would not be in legal posession of a handgun in NYS without a permit...

    in Tn , and have never arrested or heard of some-one being arrested 4
    having a 'gun' in their vehicle ( unloaded & cased !!! i.e. = "transporting" as per this topic was to be all about )!!! and NY is still not a part of this discussion or relative to it !!! Anyhow , some 'good' advice and some real ???? here , good luck , and I do think the FLA. 'carry' premit is a good idea 4 everyone!!!!!!!
