Is it now legal to put a folding stock on AK-47

Hello everybody. My question is, is it now legal to put a folding stock on a "postban" Ak-47? I have one of the Romanian stamped type. Thanks, Steve.

    Yes but not only do you have to comply with state laws but the 89' federal ban is still in effect, along with too many others. You know the law that among other things outlawed the importation of "NON" sporting firearms ie AK-47, FALs, HK (91, 93, 94, ect), ect, just to name a few in 1989. The 94' AWB only delt with domestic firearms since the 89' one stoped all imported guns from having the "evil" features. If you gun is an import, which it is (Romanian) it is still illegal unless you make it compilant with the 89' ban. To make it legal you have to put enough american made ATF aproved parts so that it is no longer considered an import. There have been a ton of posts listing the parts and links to the actual laws. I dont have one handy right now or I would repost the actual law and part. I am sure someone will be arround soon to do it.

    wrong, many states enacted their own ban and preban still means something to those that live within those states.

    The simple answer "yes" is not sufficient to answer the questions. I just wanted to re-state what a couple of the more astute members already said.

    1. You must still be in compliance with the 1989 ban. Basically, this means you would need to add several US made parts to a firearm such as the MAK-90 to legally add a folding stock. To add a folding stock to a foreign rifle imported after the 1989 ban, you need to add enough US made parts to qualify it as a US made rifle. On the AK, using the MAK-90 as an example, you would need to add several of the items such as hammer, trigger, sear, magazine follower, magazine floorplate, gas piston, gas tube, etc, and then add a US made folding stock, US made pistol grip. The rule is, you cannot have over 10 foreign made parts from the list the ATF has developed in order for it to qualify as a US made rifle.

    I am not sure how many US made parts your Romanian already has, but I would be willing to bet there would be some concern if you put a foreign made folding stock on it. A US made stock with US made pistol grip may be all you need, but you need to do some parts counting...

    2. Watch state and city laws. Just because the federal law expirded doesn't mean stae and city laws have.

    3. This whole parts count thing has become so rediculous, on some rifles, it is illegal to use a magazine unless it has a US made follower and base plate. Take the same rifle (including some of the Romanians) and put a 100% imported mag in it, and you have broken federal law.

    On a Federal level, you're right.

    On a State level, some states (including mine) still have high capacity bans in effect. So pre-ban mags (and other stuff) still have value, though we're talking about different "bans"!

    Thanks for the replies everybody. My state is wide open on gun laws meaning we have no unusual restrictions. I was thinking that since my gun was imported and sold during the ban that it would already have the correct number of U.S. parts. If I replaced the butt stock with a U.S. built model I would be OK or have an extra U.S. built part. I really dont think the butt stock is a U.S. part as its one of those really short ones. Please let me know if my logic is flawed. Thanks, Steve.
