FFL questions
Ok I am interised in finding out how much of a headach getting a FFL is. I don't feel it is a good idea to ask a dealer how to get one and what is involved. I know that it takes $200 for the first three years and $90 for the fallowing three. The reasons for getting it are due to stupid laws in IL, getting cheaper ammo for certan firearms, and getting firearms cheaply. Because of the laws I have to go through a dealer to get any of these. Also I do not live close to Cook County or Chicago which might make it easer. What is your input.

Looking for some answers to few questions on the FFL please.
I have read parts of the GCA and the ATF website but not been able to find any real answers, is there such a thing as being licensed to sell out of you home or over the internet? I'm curious because I see all these ads saying you can. Now if I remember right the GCA lists 9 things? you must meet in order to be approved. I failed to see anywhere it said in order to be approved with the above the biggest reason is suppost to be for profit.
How are people being approved when they don't have a store front, my understanding is you have to have set store hours so you can be inspected by the ATF at anytime during those hours to ensure compliance, along with a few others things. I understand the morjority of the requirements to obtain one and the laws that must be follwed to maintain one.
I hope this makes sense to you all, and please forgive my ignorance on alot that pertains to the FFL requirements.

Unless you are planning to actually engage in business, you will not get a Type 01 license. BATF will not issue such a license for the purposes you mentioned.
You can get a Type 03 license and be a licensed collector of "Curio and Relic" firearms if you want.

The zoning restrictions are not on the federal level, they are generally on the city level, possibly county or state level. It is not imperative that you have commercial zoning, but depends on your local laws.
I know a few FFL dealers in small Kansas communities that work out of their homes.

If you want to get a FFL in an area zoned residential, and if you cannot get a variance, you will not get a FFL. Ask my friend David Sandlin.
Maybe in those tiny towns in rural Kansas, there is no zoning. Where I live there is no zoning, so there is no problem.

You also need some type of storefront and must conduct a certain amount of business hours. There are some wholesalers also who will not deal with you w/out these. 0 -

I don't know where you guys get this stuff. None of this is Federal requirements, maybe city, county, or State requirements, but not Federal. Please, show me some Federal regs saying this, as I know a few FFL dealers who sell out of their homes, have no store front, and don't maintain regular hours. Get into small towns in the midwest and west (outside of California) it is common to find part time FFL dealers with no store front who don't keep regular hours.
Part of the Federal requirements is complying with all local laws. It may be that if the local laws require this sort of stuff, it's required by the ATF, but if local laws allow it, there is nothing on the Federal level requiring this sort of stuff.
If you find some Federal regs saying you have to have this stuff, please direct me to the statute.

I found the following link that gives some basic information and requirements for the place of business. As far as store front, signs, regular business hours, and such, according to this site, these are all governed by local laws, not Federal laws.

You will be approved for an FFL as long as you qualify (no felony record, etc.) and your municipality doesn't prohibit home based business. It doesn't matter what your zoning is, it only matters if your state or local town laws prohibit home based business either outright, or just for firearms. You will have to put some hours down on the application but you can just put a few hours down on a couple of days then "by appointment" on the rest of the days. The only federal requirement as far as zoning or what not is that you have to comply with all LOCAL laws within 30 days of issuance.
It doesn't hurt to apply. If your application gets denied then the BATFE legally has to refund your $200 and you have lost nothing.

Thanks for the information. It is a possablity that it will not work for me to get the FFL just because I am doing this for myself and am not trying to make a profit; however, if it is possable for me to get a Type 3 license it might be what I am looking for if I am still able to get certan ammo and older guns. Also the idea of me moving is a no win situation. I am going to school and not a possablity but I was a good suggestion[;)]. Your thoughts. 0 -
The ATF isnt just handing licenses out to people so they can get ammo and guns cheaper guys, it doesnt work that way. If they did you wouldn't have such a decrease in FFL's ove rthe last 5 years. We've gone from over 250,000 to under 60,000 Im told. 0 -
I lived in Will County in Illinois for many years. My Dad had a 01 ffl and sold out of his house for about twenty years with it, until a few years ago. When he attempted to renew his dealers license, and now had to abide by local ordnance, he was told since he was zoned residential, he'd have to open a storefront in a different area.
Federal law requires that you comply with local laws/ordnances. That's where they get you. Like I said, for almost twenty years he had no problem with his ffl. It's not the feds that are shutting them down as much as it is local laws, and Illinois is really tough on gun dealers selling from their house. At least Will County is.0 -
gunman it seems to me that if he had sold for 20 years they would have to grandfather his business
the guy I use for transfer works a full time job and sells out of his home he hasn't had any problems with local zoning , so i guess it would depend on your area0 -
Well , lest see , just one of the many reasons I no longer reside in the republic of Illinois ...As far as the FFL for the reasons you gave , its not worth it , find a local dealer and become friends ! 0 -
I can't speak for all countys in Illinois, but as far as Will Co. goes, they would not grandfather it. We were told we could apply for a variance, but it wasn't very likely to do any good.
I know of one other dealer that use to sell out of his house in Will Co. that went through the same thing, except he hired a lawyer and fought the system. In the end, he spent thousands of dollars and ended up opening a storefront.
They accomplished exactly what they set out to do........Get rid of the small time kitchen table gun dealers!
Since the gun business was more of a hobby, the 01 ffl was left to expire and we both now have 03 C&R ffl's. Not nearly as good, but a lot less hassle, and if you're into older stuff, it's good.0
