An FFL dealer "accidentally" sells an "assault weapon" in California.

where a dealer accidentally got sold a SU-16 C instead of SU-16 CA, but still sold it and the paperwork went through.
Is the buyer of that SU-16 C committing a crime even though he had it transfered to him (legally?) by a licenced FFL?
Does the DOJ look at the model name on all the trasnfer paperwork and check it against a list of guns they have determined to be illegal?
Whats the probablity the dealer would get caught?

The SU-16 C, feature a true folding stock, a 16 inch barrel and redisigned sights. http://www.kel-tec.com/su-16c_rifle.htm
The SU-16 B allows for M-16 sight posts to be put on, i think it also has a 16 inch barrel.
