UPS, could be a problem,read this

I read the post about shipping boxes for firearms and I thought I'd mention something very strange and very true that has happened to us twice. A very good friend of mine is a gunsmith and ships firearms quite often. One time it was him shipping to another FFL and one time an FFL dealer shipping to him....this is how it worked....All three dealers are UPS dropoff points. They boxed and shipped the guns declaring they were guns and insured them. Ups picked them up, collected the shiping fees and insurance fees. The firearms reached their destination broken in two...no problem right...insurance...wrong....Everyone contacted at UPS so far including the manager of the regional office said they will not pay...they do not consider a package insured unless it is taken directly to a UPS depot. It doesn't matter that they don't tell you this or that they collect the insurance fee which is also not refunded. I know this all seems impossible but believe me it's true. It seems like a matter to go to a lawyer but the costs of the fight are vastly higher than the cost of the guns....interesting isn't it?...if we get no satisfaction then that means UPS has been collecting millions in worthless insurance fees.

    This is an easy one...depending on the cost of the firearms.

    Small claims court on the receiving end and/or on the sending end.

    ANY judge should say...."let's get this straight...YOU collected insurance fee........and now YOU are not paying?" That is a slam dunk!!

    the gun shop where i work is a ups shipping station and this just happened last month. i shiped a gun for a customer and it was broke when it arrived at the other dealer. ups sent the man a check. they had no problem honoring the insurance. i think the shipping station just didnt want to fight it.

    That is the exact reason why UPS got sued in a class action lawsuit. If you were an UPS account holder from such and such a date you receieved $5, yeah, only five. I got my check and I was like oh this is nice, untill you read the "fine print". The $5 bucks had to be used on an account, the same account number that was on the check, you could only use it if you had $ charged onto your account. Well, I use a credit card on my UPS account, which charges me right away, never giving me a chance to use the $5 that I recieved. [:(!]

    in the first place package your guns better , I have shipped several guns using ups and have never had a problem ,, you know those boxes are going to take a beating so pack them better , use a hard case inside a box when you can , always double up on the boxes when shipping with just cardbroad ,

    as for the insurance end of it , I've never had a claim so can't say one way or the other

    They are just testing you as to how much you really want the insurance money. Get the manager at UPS that refused to pay the insurance on the phone and get his information and tell him you are sending him a subpoena for small claims. File a small claims action, subpoena the manager and have photos and witness testimony lined up or written down and notorized. They will fold on the court day. But make sure that you get all your court costs included in what they pay. Also make sure they understand up front it is cheaper to pay now because they will have to pay court costs and attorney fees when they lose.

    I have had a run in with them before. I won and they lost. I am now a must sign on their computer, but the new delivery guy understands why. All I can say is they don't deliver my packages to the wrong street any more!

    Next time use USPS. They pay claims & usually dont lose it.
    Cheaper to.

    Not being a smart azz, but that is why we stopped using ups.
    On small claims suits they try to settle for 20-30% or if forced into court.
    They usually end up paying less than the real value of the weapon.
    Really nice people, also depends on the judge a bunch.
    Seen it happen to one of our customers on a inter-city shipment. UPS laywer is budddies with the judge, you get shafted.

    It all started when they voted to make it a requirement that to be a judge,you had to have passed the BAR EXAM...oh woe is US..
