Antique gun results?

In another post it was noted that for a gun to be classified as an "antique" that it needed ot be made prior to 1898. If a gun was made in 1997 what does that change with regard to a gun made after 1898? The reason I ask is that we have a Win 1894 30WCF that the serial # indicates was made in 1897-1898. In terms of use it is as good or better than the M94s made at later dates. Other than looking at the serial number, it is the same as newer ones.

    A gun made > 1898 is subject to the same federal laws as any other firearm; the condition, caliber, or fact that it is identical to the same rifle made before that year are irrelevant.

    However, under federal law, it may be considered a "curio or relic", eligible for direct transfer to a C&R licensee.

    It doesn't make much sense. It is true. For instance, a 96 Swedish Mauser made in 1897 is not a gun. According to the BATF. But the SAME MODEL of gun, from the same production line, made 2 years later, IS a gun.

    I often wonder how long this will last. I was out shooting my 1896 dated Mosin M39 today. Not a gun? news to me![:D]

    An antique firearm is a firearm built in or before 1898, or a replica thereof. The exact ATF definition of an antique firearm is:
    Antique firearm. (a) Any firearm (including any firearm with a matchlock, flintlock, percussion cap, or similar type of ignition system) manufactured in or before 1898; and (b) any replica of any firearm described in paragraph (a) of this definition if such replica (1) is not designed or redesigned for using rimfire or conventional centerfire fixed ammunition, or (2) uses rimfire or conventional centerfire fixed ammunition which is no longer manufactured in the United States and which is not readily available in the ordinary channels of commercial trade.
