yet another class 3 question

I've been interested in obtaining the class 3, but have come across different opinions on what I can do with it. I have been told by a person from the ATF regulatory in St. Paul MN. that if I had the class 3 I could indeed sell a brand spanking new fully automatic rifle to a civilian, as long as they had a permit to be able to own one (which they said usually takes roughly 6 months to get). To me this sounds like it totally goes against the 86 ban. Is this person at the ATF just insane or what?
Another question I had is if I have a class 3 does it automatically mean that I have a class 1 as well, or do I have to pay for the 500 every year AND the renewal fees for the class 1?

    You really need to talk with <Mark Christian>...He's a very Senior member of these Forums and a very knowledgable Man and World Expert when it comes to Automatic Weapons and ownership..............

    You must first be licensed as a Class 1 dealer. The class 3 is so you can sell PRE 1986 guns to civilians, OR post 86 guns to Police Depts . As told the process is lengthy for a civilian. I have no clue on the renewal fees and how often.

    The renewal fee for a Class III SOT (Special Occupational Tax) is $500 per year. This is just an add-on to your regular license. If you live in MN, then you cannot sell class III items to the general public, except C&R items. You would also be able to sell firearms to LE and Government agencies. The only way you will be able to own new machineguns is if a LE dept. asks you to demonstrate it. If you have more questions, you can email me.

    Thanks guys for the info thus far. I live in Sioux Falls South Dakota (free state woohoo for me lol). I just sent in my FFL application (class 1), and in the near future looking to get the SOT. When I had gone into the sherriffs office for him to sign the FFL he was happy to do so, of course after he did the background check on me, when I gave it to him the first thing that he said was "this isnt for machine guns is it"? How much of a problem do you think he'll be when I go in to really get him to sign off on a class 3? If he doesn't feel like signing off can I go to someone else or am I screwed? While I was there got my concealed permit too hey for 10 bucks you cant beat it.

    Just some common sense.. I would sell regular guns for a year or so and establish my business. Hopefully it will succeed. Go back and visit your Sheriff later. Good luck.

    I hate to rain on your parade, but I think that you are getting all excited over something that just isn't going to happen.

    You don't just "get a license". Getting a Federal Firearms License is just one step in the process of establishing a business selling firearms. You don't necessarily have to open a store; some folks sell guns that order for others. But, you do need a plan, zoning, & state/local licenses; if you don't, BATFE won't issue a license to you. And, you need a safe to store your guns. If you haven't already taken care of these things, your application will be denied.

    You don't need a sheriff's signature to get a class III license. You need to get a regular FFL and then apply for a SOT.

    I have my business certificate, sales tax id, will be going for the home occupation permit this week (20 bucks) and FFL is in the mail. As far as owning a gun safe technically you dont have too. The certification you have to sign says that secure gun storage OR safety devices will be available at any place in which firearms are sold under the FFL to persons who are not licensees. so you dont need a safe perse just something to prevent the firearm from being usable. Now of course its very prudent you should have a safe, no doubt about it. I believe you also have 30 days after getting your FFL to comply with this request, I mean hell it would suck to buy a decent sized gun case to find out you get rejected.
