Curio and Relic continued

DEEREHART
What firearms can be transferd with a curio and relic license? I have looked around a little and find conflicting reports,about the only for sure that I can find is "antique" as defined by the ATF website. Can some newer firearms be transferd?[?]

    A C&R is any gun 50 years or more old, or a gun < 50 years old when on the ATF C&R list. A C&R must be complete & in original issue configuration.

    In full compliance with state and local laws, any firearm that is over 50 years old or is specifically listed on the BATFE List of Curios and Relics (they can be of any age) can be transferred to holders of Type 03 FFLs, commonly referred to as a C&R license. There is a minefield of state laws out there that you have to contend with so don't think of this as a one size fits all situation.

    You have to be able to doccument that it is over 50 years old. Serial #, production dates for a particular model, most any valid reference material that will prove it is over 50 years old. There is another clause that has recently been added to the mix that states that all C&R guns must be in their original configeration. That gets to be a grey area open to interpretation. I hated it when they did that. It originaly only applied to military guns but some idiot added the wording that it applies to all C&R guns. It is hard to find a 50 year old gun that has not had some work done to it. What about a military gun converted to a sporter in the '40's??

    Thanks for all the info guys I do feel more informed,enough so to call the Seattle ATF for the packet in the morning [8D]

    Have recently talked with ATF Firearms Tech branch on the issue of C&Rs and "original condition". Their view- since this is a license to COLLECT- if changes made to a firearm would trash it's collector's value, it loses C&R status. Sporterize a SMLE, no collector's value. REPAIR a SMLE, OK. A MINOR change, like sights, reblue, no biggie. Savings for one transfer fee covers cost of license, and as others have pointed out, Numrich, Brownells, etc, give a nice discount to C&R FFL holders.

    what do you have to do to get a C&R and how long does it take

    Summit your application with the BATFE and $30 fee and wait from 2-6 months for them to send you your license if all checks out ok. It should also come with a large package of paperwork and a book listing the rules and what guns are on the C&R list. When you get your license make 2-3 dozen copies of it. DO NOT SIGN YOUR LICENSE You will sign the copies in blue ink as you use them.
