If I were to build a copy of a Westely-Richards Monkey Tail breach loader with percussion priming, where would I stand with the BATF?

Even that would be subject to excise tax, though. There were several muzzleloading gunsmiths harassed by the IRS several years ago. I think it broke John Bivens and he turned to reproduction cabinetry instead of guns. 0 -

Other than machine guns (and being sure to comply with state laws) you can build any firearm for your own use and it is not the concern of the BATFE or anyone else. You don't need to serialize it or even place your own name on it...Just don't sell it! 0
