Damaged Gun When Shipped

    I don't think a dealer should ever unpack a gun until the buyer is there to witness it. Otherwise, the seller will blame the dealer and he may be right. JMO.

    Still, notify the seller. He's responsible for safe packing and hopefully bought insurance. Keep all of the packaging!

    He can TRY to blame the dealer, but if the seller bought insurance he wouldn't need to. Insurance protects the seller- not the buyer.

    I wish every one of my customers was there when I open the box, but 90% of my firearm shipments arrive with nothing on the outside to indicate who that shipment is intended. If it was, I could call my customer to come over and watch me open the box.

    FFL's are also required by ATF regs to log the firearm serial number into our bound book by close of business the next day. If the customer doesn't arrive by then, I'll open it.

    Why hammer UPS. They all damage packages. Just be glad it's not the USPS. They damaged a scope that was insured and refused to pay the claim. Figure that scam, they get the money for the insurance and then refuse to pay and their is nothing you can do.

    I received a rifle through USPS. It arrived with the stock broken in half. The shipper received settlement from them but it took some months. I think USPS treated him fairly as he sold the damaged rifle to me at a greatly reduced price. YMMV

    The problem is with the USPS, you take the item in to the postmaster to file the claim. When he send in his paper work, if he states that he fells it didn't happen is shipping. YOU ARE SCREWED!!!!!! My postmaster wanted me to make a partial. I told him on it's damaged, I want the full insured amount. After that it ws all over.

    Notify the seller of the damage and have him begin the claim process on his end. Your dealer (the recipient) will have to retain the gun and the shipping box for inspection. If the seller will take the gun back as is and refund your money then your worries are over. If you still want the rifle, but with an "adjustment" then it become more complicated.
