New Jersey Magazine Ban
I have some pre ban AK74 30rd mags that I sold on Gunbroker yesterday. The buyer is in New Jersey. I informed him that as far as I could tell High Capacity Magazines over 15rds were not legal. He assures me that purchase and posession of pre ban mags are allowed just like in New York and Mass. Does anyone know if this is true.

I'm pretty sure that importation of high cap mags into MA is not legal (outside of law enforcement).
Pre-ban mags are OK within the state, assuming the possessor has the LTC-A unrestricted license.
Like everywhere else, enforcement of this law is pretty tough since its hard to prove when a mag was made or imported.
I strongly suspect the same is true in NJ, but if so I think that would be the problem of the importer (ie your buyer).

Whoever not being licensed under the provisions of section 122 violates the provisions of this section shall be punished, for a first offense, by a fine of not less than $1,000 nor more than $10,000 or by imprisonment for not less than one year nor more than ten years, or by both such fine and imprisonment, and for a second offense, by a fine of not less than $5,000 nor more than $15,000 or by imprisonment for not less than five years nor more than 15 years, or by both such fine and imprisonment.
The provisions of this section shall not apply to: (i) the possession by a law enforcement officer for purposes of law enforcement; or (ii) the possession by an individual who is retired from service with a law enforcement agency and is not otherwise prohibited from receiving such a weapon or feeding device from such agency upon retirement.
So, my read on this is that "pre-ban" mags are OK. Also the law specifies that the mags have to have been lawfully possessed, though it doesn't specify that they have to have been possessed in state.0 -
Laws in 1 state are rarely the same in another; magmax's buyer is located in NJ, so that's the only one that counts here.
NJ law, with the possible exception of recent changes, can be found in ATF P5300.5 (State Laws & Published Ordinance - Firearms). Large capacity ammunition magazines (capacity > 15) are discussed on page 285: "Any person who manufactures, causes to be manufactured, transports, ships, sells or disposes of a large capacity ammunition magazine which is intended to be used for any purpose other than for authorized military or law enforcement purposes by duly authorized military or law enforcement personnel is guilty of a crime of the fourth degree."
Now, I'm not an attorney, but I did sleep in the dumpster behind a Holiday Inn Express last night. This sounds to me like the buyer can receive or possess a hicap mag, but the seller or transporter could be in trouble. Since magmax doesn't live in NJ he is not subject to NJ law (other than firearms laws); of course, a hicap mag is not a firearm. The only thing magmax needs to keep in mind is that he could never set foot in NJ, maybe not a bad thing.
But, maybe I'm wrong. I wouldn't blame anyone who decides not to get mixed up in shipping anything to NJ. If the big companies won't ship to NJ, maybe they know something we don't.

Several months ago, we sold a Springfield XD 9mm to a gentleman from New Jersey (our shop is in PA). He arranged shipment to a NJ FFL dealer and we shipped to the dealer. Two days later we got an irate call from the dealer - we had included three 17 round magazines with the pistol and he was pissed that we put him in jeopardy. He shipped all three mags back to us ASAP and we found and shipped him three 10 round mags - couldn't find any 15 round mags for this piece. 0 -
As crazy as it sounds, can you insist that the guy in N.J. have an FFL receive it for him? No reputable FFL will receive them for him if they are illegal and the FFL will be glad to tell you so.
From all the information already brought up here, I would be very hesitant to send them without some FFl or N.J. police source telling me that it's okay. This sounds like one of Bloomberg's schemes. Now, where's my tinfoil hat?0 -

I live in NJ and have received shipments of mags, primers, powder and ammunition at my house from Cabelas, MidwayUSA and others.
NJ has some stupid restrictions, I own black rifles, they just don't have flash suppressors. You can't have rifle or pistol mags over 15 rounds, idiotic rule but largely irrelevant. There is no handgun I cannot possess. 20 years ago the Governor came up with a list of guns you couldn't own. The list included mini-14's but not mini-30's, AR-15's but not any other A2's. Needless to say, the list has been replaced and largely eliminated.
NJ is a blue state up north, a rural farming state down south. We have our guns and the state is far freer than NY, CA, MD or MA, not that they are any standard to go by.0 -
NJ needs a firearms ID issued by the state just to be able to buy a long gun firearm plus also they need that ID to buy a AIR RIFLE in state.. Handgun purchases are crazy also .. Atleast in NY we may have 10 round capacity rule but we dont need a firearms ID to buy a long gun anywhere but NYC limits.. 0
