Can I sell a handgun that I do not know if it has ever been registered and do not know who the original owner was?

    I am a new seller & have been asked to accept a postal m/o instead of using paypal. he says paypal is anti gun & will take the money. I have an escrow account. How should i respond?

    without knowing your state and city of residence no one can answer your question, as there are too many laws and regulations that vary city to city county to county, state to state.. it may be perfectly legal or it could be a felony. we need more info to help.

    Go to the NRA website and see if there is a gun club near you pay them a visit on a week -end and ask their members or you can go to a local gunshop/dealer and ask those questions. He may or may not want to help you as he makes a living selling fire arms . Yu can also go to a police station and ask without giving your name or address. As Tank said each state and city may have different laws.

    I was referring to selling it on GUN BROKER.COM
    I am in Cedar Hill Missouri (Jefferson county)

    Of course you can.

    I think the question is "Can I *LEGALLY* sell it", etc.

    I don't know, since I am not familiar with the laws in your particular jurisdiction. My cursory search indicates that person-to-person sales of guns are legal in the State of MO, so long as the buyer isn't a felon. So you probably CAN do this. As mentioned, you might check with the members of a local gun club.

    I wouldn't ask the local police, since suprisingly, lots of cops actually aren't particularly knowledgeable about the intricacies of State gun law in their jurisdiction. Gun store owners generally ARE familiar with these rules, though some of them may not want to help you with any sale in which money doesn't flow into their own pockets. (Short-sighted, IMO, but there it is).

    If you want to list for sale on Gunbroker, then you may want to sell the gun OUT of State.

    If so, you're going to have to go through an FFL dealer to legally handle the out of state sale. In that case you can simply ask this dealer if there is any reason you can't sell it out of state. Since his business revolves around making or facilitating gun sales legally, he should be able to help you do this.

    Note, that some dealers don't want to participate in internet sales, since they think such sales are competing with their business. Again, personally, I think this is both short-sighted and dollar-foolish, since they're basically getting paid to fill out a form and mail a package, but that's their call.
