Maryland Gun Laws and frames "in the white"
Greetings, Thank you in advance for taking the time to review my question.
This is a hypothetical question specific to Maryland state laws on purchasing a handgun and providing a fired casing. I do not live in Maryland and although I'm pretty good with the various gun laws MD is a bit on the fringe.
I understand Federal law and the handgun in question is on the MD registered list.
The handgun in question is "in the white" meaning it is a Caspian .45 handgun with only a frame and slide, no barrel or firing mechanism. The frame is of course the firearm with the serial number.
Questions:
a) How would a resident of MD purchase and receive an "in the white" handgun since it cannot produce a fired casing?
b) How can a resident of MD purchase this frame from a resident of another state? Yes, FFL to FFL, but how then does the MD resident pick up the gun from the MD FFL? Again, cannot provide a fired casing.
c) Are there exceptions to this and what is the specific definition of a curio or relic under the MD C&R law?

It depends upon whether or not the seller can document the date of manufacture of the frame. If the frame was made > 1/1/02, a fired casing is required; no casing, no approval by MSP.
MD law does not address C&R's. However, MSP has determined that a MD resident may receive a C&R handgun directly from anyone outside the state, but such transfer inside the state must be approved by MSP.

EDIT: Joe, they were one step ahead of us; the requirements for this law, as well as the internal lock requirement, are based on date of manufacture. But, as far as a frame is concerned, there is the possibility that MSP might approve it's transfer without the case; we just can't be sure. I attempted to get First Sergeant Frank Smith to post his determinations in writing on his website, but he has refused to do so.0 -
Is this possible? Is the Cartridge case requirement for new firearms sales only? Here's a scenario (If Possible):
Have someone "buy" the caspian setup while out of state. Then they go to the FFL and X-fer it to you.
It then becomes the transfer of a pre-owned firearm.
You may have a loophole. Make certain that the MD cart. case laws do not pertain to pre-owned firearms. You may be able to skirt the law. Good Luck! Joe

You might run into the Federal "straw buyer" statute with that plan though?0
