WV Open Carry law
According to Wikipedia (I know, I know) WV is an open carry state. So if a person has a concealed carry permit and they reach up and expose their firearm, could this still be considered brandishing, and why?
A call to the Sherrif's office here got the reply that 'open carry is only allowed with an unloaded firearm.' WTH? Surely that's not correct....
Please comment.

Thanks for the suggestion but there is no way to post a question that I can find. I did call and was told Tom Smith was the guy with the answers. But of course he's out and his VM is full.
Any other ideas are welcome

Well let's look at it from a different angle then (since I can't seem to get a definitive answer for WV), What about CCW in the *other* open carry states.....
If you live in AZ, NM, AK, etc and inadvertantly display your firearm (shirt rides up, etc) -- how is the law interpreted there?

I'll be at the Friends of America Rally on labor Day...they sold out 60,000 tickets...gonna see the Nuge, Hank Williams Jr, Ollie North, Sean Hannity, and Rich form Big and Rich
That is being held on Private Mine Property(i believe) so I imagine they can restrict firearms, open carry or not. I will be carrying concealed, unless it is well posted, then I will think about it....
Brandishing, usually requires the intent to intimidate, or menace in addition to the display of a firearm....ie pointing, or verbalized threats...0 -
