Advice on shipping to CA.
Can you ship C&R category rifle with remove-able clip to a C&R holder who is not a FFL dealer? (The rifle is WW2 era). Or should a FFL dealer be involved?

Yes, you can ship C&R rifles to Calif. You can also ship the magazine unless it holds more than 10 rounds. It can go directly to the C&R 03 FFL licensee. The only time an 01 FFL needs to be used is for C&R "handguns".
I assume you mean "magazine" when you say removable "clip". Is the gun by chance an M1 Carbine?0 -
It is an SVT40. An FFL advised me to have the buyer broker the deal through an FFL only. I dont want trouble you know!

Your FFL is wrong. If the gun is over 50 years old, it qualifies as a C&R gun and does not need to go thru an 01 FFL as long as it has not been modified from its original configuration. It can go directly to the C&R 03 FFL.
The SVT 40 magazines are 10 rounders and are "legal" in calif, so it can go with the gun. If your buyer has a C&R lic and you insist on going thru an 01 FFL, he may back out. Its your call, if you want to error on the side of caution and use an 01 FFL, go ahead.0 -
If the SVT is C & R eligible and greater than 50 years old it can be mailed directly to a Type 03 C & R FFL in CA. I have no idea if the SVT has a greater than 10 round magazine - greater than 10 rounds can not be imported into CA, 10 rounds or fewer can be imported into CA.
Parts for a greater than 10 round magazine can be imported into CA if it is for the purpose of repairing a preban hi capacity magazine. For example, I own an M1 Carbine and about 30 hi cap magazines. Should one of those magazines become damaged or no longer function properly I can receive replacement parts to include the spring, follower, floorplate and magazine body - they can all be sent at the same time disassembled. If I however own no hi caps or import those parts for the purpose of assembling a new hi cap magazine, that is a violation of CA law.
With respect to C & R eligible long guns, CA uses federal guidelines to determine C & R status for a long gun. However, a C & R eligible long gun must in addition be greater than 50 years old in order to be shipped direct to a Type 03 FFL in CA. A C & R eligible long gun that is fewer than 50 years old must be sent to an FFL dealer. A CA resident with a C & R FFL would then have to wait 10 days to pick up the long gun, unless they have a COE in which case they can take it immediately.
Edit: Just to "piggyback" on the above post, CA FFL dealers charge a fair amount for transfers - adding about $150.00 to the cost of the gun is not unheard of. I have a C & R FFL and a COE. If I did the deal and satisfied the legal requirements I'd figure the gun should be sent, which sounds like the case here - never hurts to check though.[^]0 -
