I have been serching through the NYS Penal Code and haven't been able to fins an answer for the following question: What is the maximum round per magazine capacity allowable for semi-automatic pistols for civilians with full carry license in NYS?

I am interested in purchasing a Beretta PX4 Storm sub-compact, either .40 caliber or 9 mm. The 9 mm has a 13 round capacity. Some have told me it is allowable under NYS law, others that its is not.

    Have you tried calling the closest legitimate shop and asking?

    Yeah. One shop told me 10 another told me 13. Both shops are licensed.

    If you asked ten different ATF agents this same question, you would get ten different answers![;)]

    Since the PX4 Storm is a post ban of 1994 model, it is limited to 10 rounds...unless there are Preban magazines that fit it, that were made before May of 1994.

    Anything the federal ban had in it before it sunsetted in 2004, still is valid in NY.

    A good example...I bought a new Glock 19 last year. I have several Hi Cap magazines that were made before May 1994 that are legal to use in my Glock. Hence..if a Beretta model 92 or96 magazine fits the Storm, you can have a High cap.

    10-rounds max unless the magazine was manufactured prior to September 14, 1994. I had to buy 10-round magazines for my Springfield XD-9 (which had 13 rounders) because no mags were made for it before that date.

    "Large capacity ammunition feeding device" means a magazine, belt, drum, feed strip, or similar device, manufactured after September 13, 1994, that has a capacity of, or that can be readily restored or converted to accept, more than ten rounds of ammunition; provided, however, that such term does not include an attached tubular device designed to accept, and capable of operating only with, .22 caliber rimfire ammunition."

    10 rounds or less ..Anything before September1994 is anything goes .. may be limits in the city or in your jurisdiction though..
