Modern and antique?

What are the qualifications for 'modern' guns, and what are the requirements for 'antique/curio' guns? l read somewhere that it has to be a 1898 model or before, but l dont think that was GunBroker.

Also, is it true that antiques/curios arent required to be shipped to an FFL holder?

    There are two different age and qualifications for Antique and those that are considered Curio/Relic. And both of these are different from modern Antique is any firearm pre 1898 and by federal law you can ship these just like a brick in a BOX However some states have stricter rules YOU need to know these states laws. The Curio /relic is any firearm 50 years or older in original configuration and many newer guns that are on a BATFE list these can be shipped to a C&R LIC. Holder in federal law but again some states do not allow and must be shipped to FFL holders. e

    Antique- firearm made in 1898 or earlier, OR a reproduction of a pre 1899 firearm that does not use ammunition currently available (so a carbine in cal. .58 Spencer Rimfire made last year could be an antique) OR a firearm that uses loose powder and bullets, without regard to age ( a 50 cal muzzleloading BP rifle, a reproduction of a .44 ball and cap revolver, etc) Antiques, under Federal Law, are not firearms, and are not subject to the requirements of the 1968 Gun Control Act (dealers, shipping, etc) As the man said- some STATES have tighter laws.

    Curio & Relic- A firearm that THAT particular firearm is 50 yrs old or older. A Marlin 39A Made in 1955= Curio or Relic. Marlin 39A made 2008- modern firearm. OR a firearm on the Curio & relic list published by the ATF. (ALL Winchester Mdl 88s, ALL Colt Woodsman pistols, etc, regardless of age) Curio and Relic firearms ARE subject to the 1968 GCA, however, there is a separate license category for them.

    DEALERS have an 01 FFL. COLLECTORS can get an 03 FFL- which covers Curio & Relic firearms. Allows them to buy and sell C&R firearms (for the purpose of collecting, NOT running a business)much the same as an 01 Dealer does. I find a nice M-1 Garand for sale (they are over 50 yrs) in the next state. Send seller payment, a signed copy of my 03 FFL, he can put it in the mail to me.

    In the sense of firearms that use cartridge ammo, "antique" means a pre -1898 manufactured receiver, and yes MANY jurisdictions (but NOT all) will let you just mail them from point A to point B without any paperwork, licensing, background check, etc.

    "Curio and relic" (C&R) is a little different.

    I think by definition any gun made in 1898 or before would qualify as a C&R, but its a totally different category.

    The definition is somewhat complicated, but it includes any INDIVIDUAL gun (not type of gun) that is a. more than 50 years old, b. was certified by the director of a museum as a curio or relic, c. is recognized on the ATF's published list of Curio and relic guns, or d. derives a substantial portion of its value due to historical connection or collector's status.

    For example, Yugoslavian SKS rifles manufactured in the mid 1960s are C&R guns, even though they aren't (yet) 50 years old, because the ATF has listed them on its "list" of guns with collector's or historical interest.

    If (as a purely hypothetical example) you managed to get your hands on Saddam Husseins personal Walther PPK pistol with provenance, (or as a more grisly example, the shotgun that Kurt Cobain used to commit suicide) then either of those could be a C&R gun, even if the guns are of relatively recent manufacture, because of their historical/collectors value.

    Any gun owned by a historical figure, or used in a historical incident would likely qualify as a C&R, again, so long as most of its value is derived from its historical connection (ie compared to other similar guns without that historical connection).

    In some cases, individual examples from limited or special runs of commercially manufactured guns qualify as C&R guns, because of collector's interest.

    Advantage of a C&R is just that the licenses are relatively easy to obtain, making the buying and selling of these guns much easier among dedicated collectors. While you are allowed to dispose of individual guns in your collection, you may NOT use your C&R FFL license to do business as a gun broker.
