FFL's QUESTION ABOUT 4473 FORM

Is it legal for you to do a background check on a potential customer if they send you their drivers license information then after you get them called in and approved have them fill out the form ? For example Billy bids on an item here and wins but lives 3 hours away and wants to come get it..He wants to make sure he gets approved without any hassles before he drives 3 hours ..Can you do this ?

    Can't attest to the "nuances" of law, but:
    I've been OK'd by my FFL while not in his presence. The NICS was complete prior to my arriving to pick it up. HOWEVER he had prior questionnaires on file for other firearms that I've bought, and he used that.

    Personally, unless the buyer has a prior questionnaire on file with you, I'd refuse. May be an ATF trap. You never know, these days. And one other thing...why is he so worried about being denied?

    No Sir! Until you get the word from a reliable source that it is legal, have him fill out the form first. Best, Joe (Greene County, NY).

    I would give a thumbs down on this as he HAS to sign the 4473 prior to getting a NICS check. If he's a felon attempting to buy a weapon, the feds need proof he lied on a government document to prosecute.

    I agree. If he's a convicted felon, he'll simply deny that he tried to buy a firearm and you'll have no signed documentation to prove otherwise.

    You need to read the September 1999 FFL Newsletter.

    If you request a NICS without a 4473 in hand, you could lose your license. Or, worse.......

    NO! You can not do a background check prior to them filling out the form. It's not even close to being legal.

    True ,,, you must have a correctly completed 4473 in hand (done in person , in your shop?) before doing the NICS !!!
