Shipping Question

Can I with a C&R licence ship a C&R Hand Gun to an other C&R licence holder in an other state? I got a no from the ATF office in Philadelphia and a yes from another agent several days later.

    Need a little help here.I sold a rifle that qualifies as a C&R relic. The buyer wants me to ship it to his work address since he is not usually home to sign for it. Question, can i ship to his work address even though the address on his license is different? I don't want to violate any rules.thanks in advance. Dave

    Since you have not FFL, be sure in your description to state that you are not an FFL and must ship to an FFL that accepts from a private seller. You should receive a copy of his license, and you can check on-line with the BATF to be sure it is valid. If you are only willing to sell to an FFL, you had better be willing to sell at wholesale. So you can sell to anyone provided you ship to an FFL.

    Some FFL's do not like to send copies of their license to nonlicensees. You don't really need a copy of his license, just the license number. You then do an ATF Insta-check to verify the information he gives you.

    I would like to sell the Gun to the highest bidder and ship it to an FFL that is close to the winning bidder. Is there a list of FFL holders that I can contact? Should I leave that up to the winning bidder? What should I expect to pay as a fee? I expect the gun to sell for $500-800 if that matters. Thanks for the help!

    It is the responsibility of the buyer to locate an FFL near him, willing to accept delivery from you, a nonlicensee. In fact, he should do this BEFORE he bids.

    It's up to the bidder to provide you with the name of the FFL he wants you to ship to. You do not need to contact every FFL near the buyer. Usually if some one bids on a gun he has someone (FFL) that he is going through. He should then send payment along with a copy of the FFL's license signed in ink with the shipping address which should be the same as on the FFL license. You want a copy of the buyers FFL to cover your ass. You may also have to show this to UPS so they know it is going to an actual dealer. Make sure you state as to who pays the shipping and list the shipping rate in the auction. Use UPS to do the actual shipping. FED/EX will also ship firearms but they require you to ship them express. That can make shipping more expensive. You will most likely have to take the firearm down to a UPS shipping center not one of those shipping stores. You do not pay any fees the buyer will have to pay the receiving FFL (HIS FFL) any transfer fee. The only money you will pay is to Gunbroker and that is determined after the auction.

    Okay. You are selling a long-gun (shotgun, you said.) This is what I do:

    1. You do not have an FFL. You don't have to have a copy of the buyer's FFL. You would only need a copy if you were also an FFL.

    2. Since it's a long gun, you, as a non FFL can legally ship it via the US mail at a far lower rate than the common carriers. Priority/Delivery confirmation/Insured. Pistols are a no-no to send in the mail as a non-FFL..but you're sending a shotgun.

    3. Buyers FFL will most likely not give you a copy of his FFL. He doesn't have to, as you are not an FFL yourself. That's OK! Just get his FFL number. You will need the first, second, and final groupings of his license number.

    4. After receipt of the FFL license number, and the payment, find the FFL E-Z check link (available on the Gunbroker homepage under FAQ's, I think) and send the firearm to the address that appears on the E-Z check link and to that address only. Advise buyer you will be shipping to the address on the FFL E-Z check website only. If they are legitimate, they should not complain. This is to prevent unauthorized use of FFL forms (stolen, with altered name/address etc). Best, Joe

    IN ADDITION TO THE ECELLENT ADVISE ABOVE, YOU MAY WANT TO CHECK TO SEE IF YOUR SHOTGUN IS ON THE CURIO & RELICS LIST (OR OVER 50 YEARS OLD). YOU COULD THEN SELL DIRECT TO A 03 FFL HOLDER (HE WOULD SEND YOU A COPY OF HIS '03' FFL). THIS WOULD ADD TO THE POTENTIAL BIDDERS.
