Private Firearms sale - Across state lines
I did not see any clear answer to this so I thought I would ask.
My sisters husband died a while back. He had a 9mm handgun she wants to give me. She lives in Michigan & I live in Tennessee. I would be picking it up, no shipping involved.
What paperwork is involved?

It must be transfered though an FFL to come to you legally. She either needs to ship it to an FFL in your state, or have an FFL in her state ship it to an FFL in your state. If it were a long gun, a face to face transfer might be legal depending upon state and local law, but not with a hand gun. 0 -

(B2) From whom may an unlicensed person acquire a firearm under the GCA? [Back]
A person may only acquire a firearm within the person's own State, except that he or she may purchase or otherwise acquire a rifle or shotgun, in person, at a licensee's premises in any State, provided the sale complies with State laws applicable in the State of sale and the State where the purchaser resides. A person may borrow or rent a firearm in any State for temporary use for lawful sporting purposes.

Why don't you get your sister to bring to your house and leave it there for HER to shoot when she comes to visit in the future. [:p]or you could pick it up and take back to your house to clean and oil for her [:)] 0 -
Blurring the lines here- is she SELLING you the handgun, or did her late husbands LEAVE you the firearm? If SELLING you a handgun, then the info already posted applies. There IS an exception in the Federal law for acquiring a firearm by INHERITANCE from another state:
(3) for any person other than a licensed
importer, licensed manufacturer,
licensed dealer, or licensed
collector to transport into or receive in
the State where he resides (or if the
person is a corporation or other business
entity, the State where it maintains
a place of business) any firearm purchased
or otherwise obtained by such
person outside that State, except that
this paragraph (A) shall not preclude
any person who lawfully acquires a
firearm by bequest or intestate succession
in a State other than his State of
residence from transporting the firearm
into or receiving it in that State, if it is
lawful for such person to purchase or
possess such firearm in that State, (B)
shall not apply to the transportation or
receipt of a firearm obtained in conformity
with subsection (b)(3) of this section,
and (C) shall not apply to the
transportation of any firearm acquired in
any State prior to the effective date of

How i read it was she was GIVING it to him, i didnt realize that it became illegal to gift to a family member that resides in another state. 0 -

Personally, here is the scoop...
It will cost her probably $25.00 for shipping plus most likely up to $40.00 for a transfer dealer to send it to your transfer dealer. Your transfer dealer, will then charge you most likely up to $40.00. That is a total of $105.00...can either one of you drive to each others home for that amount? That would certainly make compliance with all the laws unquestionable.
