1891 Argentine Mauser sale to C & R licensee?

Can we legally sell and ship out of state to a C & R licensee for an 1891 Argentine Mauser 7.65 rifle? (He has no FFL and is trying to save having to go through someone in his state who has the FFL). We have our FFL but the manager is out today and I thought someone would know this........Thanks

    You would normally be legally allowed to ship that particular type of rifle to a Type 03 FFL (C&R). Normally though, the purchaser and the Type 03 FFL (C&R) holder must be one and the same. I have such a Federal Firearms License, and am allowed to use it only for purchases for myself, not to "share" with friends, or function in any way as an intermediary or dealer, as I understand the regulations and the intent and spirit of the license.

    If it's stamped on the left side of the receiver, "Manufactura Loewe Berlin" it's "Antique". That requires no FFL or C&R license, you can ship it directly to his address if he meets the requirements of the state and county he resides in.

    Tidbit: I would ask for a photocopy of buyers drivers' license, as well as the C&R copy. Check to see that names/addresses match on both documents, and ship to that address only. Just my 2c. Joe

    Open question: will ATF ever list 03's on their E-Z check website? Any rumours?

    That's right.
    And if it says DWM it is not an antique.

    Type 03 FFLs were listed when the eZCheck site first came on line. They were removed about a month later after complaints about privacy issues piled up at the ATF.

    A Type 03 license can be verified by calling the eZCheck toll free telephone number (1-877-560-2435). I verified an 03 FFL a week or two ago and it took less than 30 seconds from the time the phone started to ring at ATF.

    To summarize- A Ludwig and Loewe stamped gun is an antique. It can go directly to the buyer.

    A DWM gun MAY be an antique but there is no reliable documentation to prove this so you must ship to an FFL or a C&R holder.

    If the gun has been altered in any way out of military configuration it is no longer C&R eligible.

    A C&R dealer may purchase for his own use only, not to transfer to a freind. The buyer and the license holder must be one and the same. Not to say he can't sell the gun later, but he can't use the license for personal buisness or profit.
