Keep old Jeff out of jail pals

OK. I plan on selling a large amount of 30 rnd AR mags on GB. I would like to package them with the 2 or 3 rnd mag holders that make them really a 60 -90 round ass'y. I see disclammers that state "not shipped to CA, NY, etc". I also see ones that just say thet it's the buyer's responsability to acknowledge the laws in his residence.

What is the best approach? I can't handle 20 years (which is life for me) with bubba!

    First, I have no ideal what "60-90 round ass'y" means, legally. Certain capacity mags are prohibited from import &/or possession in certain localities; whether or not they are taped or clipped together is irrelevant.

    In my opinion, the safest approach is to state in your posting, "Only shipped where legal", ask each buyer his city, county, & state, & look them up in State Laws & Published Ordinances - Firearms (ATF P5300.5) to verify that they are legal where the buyer lives.

    EDIT: Well, if we want to get technical, this is really a Constitutional issue. A state can enact whatever (more restrictive) firearms laws they want, & federal law makes it unlawful for a resident of another state to violate those laws. BUT, magazines are not firearms, so I see no reason why the seller of magazines could be held responsible for knowing &/or following the laws of another state. There's always the possibility that some left wing deputy attorney general might find some obscure section of the Interstate Commerce Act that could be used to prosecute a violator, & I sure wouldn't want to be the test case. The fact is, there has never been an ATF arrest for violation of another state's firearms accessories laws.

    You can ship to CA of the buyer has a high capacity magazine permit, but only those of us who are dealers have these permits, which are issued to us by the CA Department of Justice. Other "ban" states probably have similar permits for dealer purchases, but I don't know the specifics.

    In my experience dont sell anything to anyone in CA. Its their problem they live there not yours. As far as NY and other places that ban high cap mags, state that you wont sell to them if it illegal because I'm almost positive that you get in trouble if you know or not.

Please know your Local and State Laws BEFORE purchasing High Capacity Magazines and Firearms. Individual Local & State laws are too numerous to list; however, the following sales restrictions will apply:

    -CALIFORNIA CUSTOMERS: Handgun sales only to "01" Dealer FFL, handguns must be on the California approved list however C&R Handguns can be shipped to 01 Dealers. No High Capacity magazine sales, No Assault Weapon sales. C&R Licensees may purchase C&R rifles only if made prior to 1955 regardless if the rifle appears on the federal C&R list. All CA Dealers must give us their CFD# before ordering. Check for other Local & State laws before ordering.

    -ILLINOIS CUSTOMERS: No Firearms sales to Chicago, Nor all of Cooke County. C&R 03 Licensees may purchase C&R Eligible firearms, however Illinois FOID card must be on file. Check for other Local & State laws before ordering.

    -MASSACHUSETTS CUSTOMERS: 01 FFL Dealers may purchase handguns that are on the MA approved for sale list, rifles without high capacity magazines. No C&R firearms sales. No high capacity magazine sales to anyone or dealer in MA. No Ammunition Sales.

    -MARYLAND CUSTOMERS: No modern handgun sales to anyone including 01 FFL Dealers. No High Capacity Magazines sales of magazines that accept more than 20 rounds. Check for other Local & State laws before ordering.

    -NEW JERSEY CUSTOMERS: No Sales of CETME Rifles. Firearms sales only to 01 FFL Dealer licensees. Absolutely no Handgun sales to C&R 03 licensees. No High Capacity Magazine Sales. Check for other Local & State laws before ordering.

    -NEW YORK CUSTOMERS: Only C&R eligible handguns will be shipped to 01 FFL Dealers and these handgun orders must be accompanied by a State Handgun Dealers License. C&R eligible rifles may be sold to 03 C&R licensees. No Sales of High Capacity magazines manufactured 09/14/1994 or after. No Sales to NY City. Check for other Local & State laws before ordering.

    -WASHINGTON DC CUSTOMERS: No Sales of any products.

    -CONNECTICUTT: No Sales of WASR, CETME Rifles, or FAL Rifles.

    I'm in NY. I've had to deal with it (item in blue). Best way to circumvent getting in trouble with the shipment is to outright ban the sale (easiest, thought not morally correct), or send magazines that you absolutely know are coded, or have features, or the name stamped on them indicates manufacture stopped prior to the date in blue above. As a "ferinstance", I have Colt stamped 20rd'ers. Colt stopped [contract] production of these magazines in 1979. Best I could do, sorry. Joe

    Yeah Neal, I don't know much about legal. I thought that maybe 2 or 3 10 rnd mags secured together might be called a 20 or 30 round mag.

    I'll take a hard look at the ATF info, probably note that I'm not responsibe for local laws (I shouldn't have to be familiar with every city in the country), & check the buyers state.

    Dog, I thought we were pals!
