dpms upper ship to california
I sold an item this weekend a DPMS Ap4 308 upper with flash suppressor and grenade launcher mount and bayonet lug. Its just the complete upper with bolt and charging handle (NO lower reciever). I just recieved the address to ship it and it in Modesto California. I dont need an FFL to ship the item but I am wondering with California's crazy laws is it legal for me to ship it to California????

I wouldn't as once the guy installs it on his gun it is completely illegal in CA--sounds like he is trying to circumvent the law.

scroll down to page 3 on that link above and you will see what I am talking about. While it does not specifically state that it is illegal to import the upper, the second that he installs it it will be illegal. I don't know that I would risk it.0 -
I believe it is legal to ship to CA, but the real question is on the buyer. If he has the same thing and is just replacing the upper (assuming it is registered in CA as an assault weapon) he is fine. If you want to be sure ask the guy for a copy of his letter from the CA DOJ certifying his assualt weapon is registered. It will tell you what it is and you can check it out to see what the current upper is. 0 -
5mm is correct about that too--but when I lived in CA I cannot begin to tell you how many people never registered their assault weapons--CA had to have an amnesty style program to allow people more time to register because they had such a low turnout. In CA a grenade launcher is considered a destructive device so definately make sure this guy has the legal ability to own it to cover your bases. 0 -
I am building an AR on an S&W lower reciever in CA and the only part that is registered is the lower with the serial number.
To avoid the assault weapons ban, one feature I must add is a magazine release such that the magazine cannot be removed without use of a tool.
All other parts I've been able to order from companies without a problem.
Is there something special about this upper that I do not know about.0 -
rsnyder55 it has a grenade launcher & bayonet lug--per the link in my post according the the AG of CA those items when combined turn it into an assault rifle and grenade launchers are considered destructive devices--so without being registered as such it would most likely be in violation---for the guy living in CA----dunno that it is illegal for bwk9 to ship it due to the grenade launcher aspect but he should check before shipping it. 0 -

Bayonet lugs are not banned under CA law and while grenade launchers are prohibited, there is nothing that bans simply having a grenade launcher mount (which is waht is mentioned, not the launcher itself). AR uppers are not prohibited and if the buyer already owns a registered ARlower he can can order an extra upper (or ten) to go along with it. Even if he does not own a lower, the upper is an unrestricted part so so ahead and ship. There are plenty of people running around this forum who simply don't want any guns or anything gun related shipped to CA to further some sort of agenda that they have, but the law allows the sale so go ahead with it.
The stepped down portion of the M4 barrel serves as the forward attachment point for the M203 grenade launcher. You'll have a tough time showing how that the simple step in the barrel allows you to fire a grenade of any sort without the launcher itself!
