What happens if I ship to a fake C&R?

Auction bidders with type 03 licenses want me to ship C&R rifles directly to them, but so far I have refused.

I understand that people ship to type 03 licensees all the time. But if they ship a firearm to a type 03 licensee and the address on the license has been altered, or the entire license is fake, what is the legal jeopardy to the shipper?

    Logically, none. However, I don't think the alphabet boys believe in logic.

    There is no EZ Check for 03's, but I think you can call the ATF to confirm.

    I have a 03,have had one for years,,all you have too do is ask for a copy of their drivers lic with the FFL,,make sure name / address match,if so and you ship to that person and it is fake its on them,you made the effort to check

    As sharpshooter said. Frankly, one of the reasons for GETTING a C&R FFL is so that I don't have to PAY an 01 FFL to receive it and transfer it to me.

    When I do an in-person transfer, I always offer my driver's license so the seller can verify, and would have not heartburn about doing so by mail. An 03 CAN be verified, just not by EZCheck. call the local office, ask them to verify that this license number is for this person, at this address.

    Anyone that would forge a C&R FFL is dumb enuff they are probably tap dance in a minefield. LOOOONG jail sentence for forgery of federal license.

    DO be certain that the gun in question IS a C&R eligible weapon. And not to be snide to you (really), but a seller that will not accept a C&R for a C&R weapon has sharply reduced his base of potential buyers. I like older Mossberg 22s- but some dealers here charge $100 per transfer. Have no interest in paying $25 shipping AND a $100 fee on a $100 rifle.

    Thanks guys. I found out that I can call the ATF at 866-662-2750. The lady there was very nice. Give her the C&R license number and she will tell you if it is legit and if the address is correct. I wouldn't go by a driver's license because it doesn't tell you if the FFL is real or not.

    I wish GunBroker.com had put this information in the "For Sellers" page. They tell about FFL eZ Check for type 01 licenses, but say nothing about type 03 licenses. (See http://gunbroker.com/User/ToolsForSellers.asp, scroll down to "Verify an FFL License.")

    I am new to online buying and selling. I know nothing. This forum has been a big help to me on several issues.

    Good for you Pencilstub, sellers that will not ship to a C&R get no bids from me, glad you are among the good guys. Suggest you send your suggestion for posting how to verify a C&R to the auction support folks, perhaps they will add in in, they can seem hard to reach at times because they are busy, but they are pretty good guys and are serious about doing this well and keeping the site the largest on-line gun auction.

    You'll lose a lot of bids if you won't accept a C&R FFL for purchase of Curio and Relics, but it is your auction so you can set your own rules. The FFL EZ-Check is set up for dealers because the information it provides is not something a collector, who's licensed premises is his own home, wants floating around out in cyber-space for anyone willing to go fishing for on the EZ-Check site. I've been in the gun business for going on 30 years and I have never come across a bogus C&R FFL. I've seen faked dealer FFLs (several in fact), but the crooks out there don't seem to have enough interest in old Mausers or Mosin Nagant rifles to fake a C&R FFL in order to get one.

    Here's another number that can be used to verify an FFL.

    I just used the eZCheck toll free phone number, (877)560-2435, to verify a Type 03 FFL. It took me less than 2 minutes from the time the phone started to ring.

    I agree with all of the above. If a seller will open his items that are eligible to C+R holders, he has just doubled or more his potential customer base.
