Payment but No FFL

Personally, I would require a signed in RED ink copy of the FFL to ship it to, then do the EZ check to boot. There is no such thing as being to safe, in todays world. He sent the payment, so you are in command...you have two choices...wait this out to hear back from him with the credentials from the buyers FFL, or send him back the $$, and relist the auction.

Well, you've got payment, so thats good.

    Did he include shipping info?

Maybe write a letter and send to him via postal mail at his home and shipping info address, explaining you've got it but you need the FFL to ship....

onemanmob As easy as it is to blame the buyer for not responding, you don't know for sure what is happening on his end. He could be in a coma in the hospital for all you know, as could his dealer. I'm dealing with the same issue myself right now, but my buyer answers his phone, just never does what he promises. I would send him a cert. letter return receipt requested. I would also keep a file of all my info. receipts etc. I would cash the MO. put the money some where safe, and put the gun aside for awhile. If he's able, he will either want his gun, or his money back. Fore what it's worth---HAWKSHAW

The Red, or Blue ink is to insure that the copy of the FFL you recieve has an original signature of the licensee, and is not a xerox copy of a stolen document. As an FFL holder, I require this when dealing with someone from a different state, that I don't know. HAWKSHAW

You have his money. I would assume that surely he will eventually want his gun and contact you. You can't do anything until he provides an FFL, which is his responsibility to arrange, to send it to.
I probably wouldn't spend the money until issue is resolved.

Thanks everyone. I was kind of thinking along the same lines. It was just kind of surprising he would avoid contact. If I had sent somebody some money I would at least try to get in contact with them. I am not realy blaming him. I was kind of thinking maybe something happend to him as well, so I ran a WWW.PIPL.COM search to see what I could find, but nothing came up. Thanks again to everyone for the help.

I had the same thing happen once. The guy sent payment, but never sent an FFL. I tried calling, and emailing for several weeks, but never heard back from the guy. That was 2 years ago. The FFL signed in red or blue ink is really not valid anymore due to the quality of color copiers.

HAWKSHAW"............THIS WENT OUT WITH THE CLINTON'S, ANY COPY WITH SIGNITURE IS OK NOW (FAXED, E-MAILED, SIGNITURE COPIED). JUST AS LONG AS YOU SHIP TO THE ADDRESS ON THE EZ-CHECK PRINT-OUT YOU HAVE YOUR AZZ COVERED.

I didn't say it was required by anyone but me. I also believe that if push came to shove, you can tell the diff. between a copy, and a real signature. If you have a FFL at risk, and the responsibilities that go with it

I asked the other day about EZ-check instead of a copy of the FFL. Well the guy that asked if this would be ok has sent me a Postal MO, but I have still yet to recieve any info from his FFL not even an EZ-check number. The auction closed on 4/21/2009. I recieved his payment on Saturday May 2nd. I have tried to call him several times, and have e-mailed him at least 6 times since then to try to get this resolved, but he will not reply to either one. Is this a common occurance, and what should I do? Here is the auction number if it helps at all (Auction # 127244386). I noticed his last bid was for a similer pistol and ended in a non-paying bidder. What do you think. And thanks to everyone for the info on the EZ-check system. It was of great help.

This is not a common occurance, I'd say you're fairly patient.

Simple solution - send him an e-mail and send him a snail mail informing him he has until such & such a date to comply with the requirements of the sale. Failure to do so will result in you returning his MO uncashed (have you verified it's authentic?) relisting the gun and shortly there after posting negative feedback.

Business is business - if something's come up that precludes him from completing the deal he has an obligation to contact you. If he's half dead or in a coma a blown gun deal is the least of his worries, but that shouldn't put you in a perpetual hold pattern.

Seems to me like the one who sent the cash and not the FFL is the one with the problem. . .not you.

After making several reasonable attempts at contacting the guy, if I were you, I'd just hold the cash, and gun, and wait.

If he wants either the gun or the cash back, he'll let you know.

If not, either send the cash back and relist. . .or hold the cash and continue to wait. . .

    1. Make a copy of the payment document. Keep [the payment copy] in a safe place.

    2. Deposit the buyers payment..don't sit on it. Sit on the money after you deposit it into your account. (While you are working to resolve this, the check will go through the system, and be found out to be legitimate-or otherwise). Once the check clears, and you have successfully resolved the problem with the buyer, then start focusing on shipping the firearm.

    3. If you are not an FFL, get the destination FFL number, so you can run the E-Z check. Then ship only to the address on the ATF website.

    4. If you are an FFL, get a copy of the destination FFL, and follow the instructions in the paragraph above.

    5. If, for whatever reason, you have to return the money, send the copy you made of his payment, and a new check/money order minus the listing fees.

Hope all works well for you. Best, Joe

Chill. No big hurry. You have the money. I have had a gun that is paid for over 90 days. Relax.

I took it to my bank to cash it. They said it looks authentic, and cashed it. Even if I have to refund the money. In my last e-mail to him I would have to keep the listing fee's. I think that is at least fair. I have been waiting for 15 days now. I can't hold it forever, but I would like to give him a fair chance. Thanks again for all of the advice.
