A&D mfgr's book question

I don't know what a A&D book is.

I have a little problem with my new AK receivers. My transferring dealer refused to mark them is "other". I have a doc from the mfgr saying that these (noted by S/N) are brand new receivers & never assembled as part of a weapon. Am I safe in assembling one as a pistol?

    I would think so, but....my opinion doesn't count.

    Request a determination letter from ATF to CYA.

    "A&D" is Acquisition & Disposition. The ATF requires a dealer to record incomming & outgoing arms in a book. This A&D book, often called a "bound book", needs to available for the ATF to inspect at all times.

    Now, why your dealer will not enter them as "other" is something you need ask him.

    What does he want to mark them as? When you fill out the 4473 what does he want to mark them as? Ask him how can a receiver with no stock or barrel can be anything other then "other" and/or find another dealer.

    Will the dealer mark pistol on the 4473? If so then no worries and you can still build a rifle out of them too.

    There is an ATF letter out there saying that if using a virgin receiver you can legally build a pistol out of it.

    Between the ATF letter and your mfgr letter you should be just fine.

    Thanks for the replies guys. Can I search the ATF to get a copy of an exting letter or do I need to create a new question/letter to them.

    Yeah Nwcid, you got it right. I had a good dealer for 10 years. Class 3 & mfgr also. Bought 3 NFA items from him and he transferred maybe 20 pieces for me. Unfortunately he tried to make a killing going to South America and buying who knows what. I know the ATF came to visit. I don't know if he is dead, in jail, or living in SA!

    The new dealer was highly recommended to me. I've been working with him for about 3 years. In that time I've purchased 6 AR lowers, a sweet single stack Kel Tec 9, and he has transferred maybe 6 pieces. No, I'm not a big spender and don't ever look to get my a** kissed but he has a kid working in there that has a real attitude. The guy is better suited to work behing a biker parts counter. Sorry riders, I was one for 30 years and have met many parts counter guys. Yes, I know there are some great ones.

    Yeah, I need a new dealer. Sorry for the rant guys but after waiting 5 months for the receivers I'm ready to start and now I'm on hold again.

    Relax, Jeff. You have the evidence from the manufacturer in your hands, that's all you need. Most folks never even see what the dealer enters in his A&D book, so don't sweat it; what he writes is not your responsibility.

    No, you can't get a copy of someone else's determination letter unless that person gives it to you. Some letters are generic & some specific to a case; it probably won't do you any good. If you are still concerned, write to ATF; it should only take 8-10 weeks to get a response.
