firearms transfer using other ffl dealers license?

is it legal when transferring a firearm to another private party via a sale to use a copy of the buyers ffl dealers license while not having your own ffl or going through a local ffl dealer and packaging and sending the firearm yourself using either ups or usps, solely relying on the buyers ffl?

    I can not quite follow your question there but I will answer the best I can.

    You as a private party can sell a gun without having an FFL involved to anyone in your state, per Federal law you need to check your state laws, http://www.atf.gov/firearms/statelaws/ . If you are shipping out of state you HAVE (federal law) to ship it to an FFL (there are a few exceptions, you would know if you were one).

    Federal law does NOT require a shipper to have an FFL.

    USPS rules state ONLY FFL holders can ship pistols. Common carrier rules state pistols have to go overnight shipping. All will ship rifles from private parties.

    Some FFL's CHOOSE not to receive firearms unless they come from an FFL.

    It is common (but not law) for you to include a copy of your DL as the receiving FFL needs to post in his bound book where the gun came from.

    thought it pretty straight forward, apparently too much info then i guess, was simply trying to give as much detail as possible; but yes that is what i thought as well and that answered the question.
    the question came from someone implying that it was legal to sell a firearm interstate by relying solely on the buyers ffl to complete the transfer of the firearm and i thought it rather strange is all so thought i would ask.

    That is a correct statement.


    You are not "relying" on anything you are following the law. If the receiver is not an FFL it does not matter how many more FFL's there are in the process as the only FFL that matters legally is the receiving one.

    The only thing the law says it for interstate transfers firearms have to go TO an FFL, not from an FFL.

    most firearms do require an ffl and you are relying on the validity of the ffl and the fact that the transaction would be covered by the ffl and was the reason the word was used in that context, i am aware that you have to follow the unconstitutional american laws. either way seems like the question has been asked and answered like any other.

    Before you make that a sticky you can't sell person to person in the state of CA.It has to go through a FFL that can do transfers or C&R Lic. holder
