Washington state residents

Residents from Washington can come to Oregon and purchase long guns, NOT hand guns, without going thru a FFL, at auctions. Does anyone know if I can go to auctions in Washington and do the same?

    Non-licensed residents cannot LEGALLY go to another state & buy ANY firearm from a non-licensee. I'm not saying that it hasn't happened, but, if caught, violators are looking at a felony conviction.

    SOME auctioneers have an FFL; they MAY sell you a long gun in another state provided such a transfer is legal in both states. Check with the auction house.

    Certainly it will only be legal if you fill out a 4473 and it gets a proceed.

    It is Federal law NOT state law that says that.

    You can only legally guy any gun face to face in your own state.
    You can only legally buy long guns out of state though an FFL.
    You can not legally buy hand guns out of state.

    You can. BUT...you have to have them shipped to an FFL in your state to take possesion.

    Where I was getting the info. If you go to liska-auctioneers.com. Go to the March 21, Oregon Dept. of State Lands and Guy Davis Estate gun auction. Click the click here for gun regulations, go down to Oregon regulations. What I understand now is that they can buy the long guns, they just cannot take them out of Oregon unless they ship them to a FFL. If they drive them across statelines it is a Federal crime unless the have a FFL?

    Not exactly.

    It isn't crossing a state line that's the problem, it's transferring possession. Since the auctioneer is not an FFL, he cannot permit someone from another state to take possession of a firearm; what he CAN do is ship it to the buyers home state FFL. Obviously, the buyer will pay for the gun immediately, he just can't HAVE it. The buyers FFL will then follow federal/local law in order to complete the transfer to the buyer.

    I don't see a range on the rental period, tell the auction house you want to rent it...[:)]

    know some exceptions.

    In Colorado, if a hunter from out of state needs a rifle, they can buy it.

    In general, a person with a residence in two states can Federally purchase in the second state if they own a home there and are residing at that time.

    The issue here is from whom an out of stateer can buy. You cannot legally buy from an individual and carry the rifle home. You can buy from an FFL and carry it home. You can buy from an individual or an auctrion firm which has no FFL and have the rifle shipped to your transfer FFL in your home state. This really is not that difficult. I live in New Mexico, I can buy in Colorado from a dealer, and crry it home, no problem. I can, and have, bought from a dealer in Arizona, and carried it home, no problem. I can, and have, bought from a dealer in Missouri and carried it home, no problem. I cannot carry home a had gun, that must be transfered through an FFL. The same if I buy a long gun from an individual. In any of those cases, a legal purchase will require a 4473.

    I believe MBK is incorrect. You only have 1 legal residense. Now if you formally chane your residense by changing say your drivers lic it would work but I've tried to by a handgun in my second home state and been refused as my license shows the other state
