    Need a little help here.I sold a rifle that qualifies as a C&R relic. The buyer wants me to ship it to his work address since he is not usually home to sign for it. Question, can i ship to his work address even though the address on his license is different? I don't want to violate any rules.thanks in advance. Dave

    No you may not. The shipping address must match the address on the license. Did that once; the person at Interordnance was fired immediately upon discovery of the mistake.

    On a C&R FFL you cannot ship to an address other than the one listed on the FFL. Dealer shipments are entirely different in that regard, but C&Rs are limited to the licensed premises only.

    When I had my C&R, I ordered and had shipped to me over 100 firearms. Since I worked, I was not at home when mail man came to my house - he always left an "attempted delivery notice" form - which I had to take to the main post office or the one listed on the form - to pick-up and sign for the packages. I became well known to several of the counter workers as well as the post master. UPS was a different story - about a quarter of the time the delivery guy left the packages on my side porch???? Most of the time, he left a notice of attempt to deliver - there was a number on that form which allowed me to divert the delivery to my place of work by calling before 6pm on the day of delivery. Packages then showed up at my work place the following day.

    And that was technically illegal every time. UPS screwed the pooch, potentially, on this one! Not sure who you work for but often times recieving a firearm in the UPS shipment is against corporate policy and grounds for dismissal; but I'm sure that is a workplace issue more than one of strict public legality.

    I'm thinking that this would be allowed under the regulations since the original delivery attempt was made to the address listed on the FFL.

    When I called the U.P.S. 800 number (not the local hub)to arrange for divergent delivery, I had to provide personal I.D. including SSN, package tracking number and a code number written on the "attempted delivery form" - there was no mention of what was in the package - and there was no question of content by U.P.S.
    As for Corporate Policy - I was the General Manager (ownership group was off site) and I established a gun friendly policy. We also received UPS deliveries and pick-up on a daily basis.

    Well, that makes sense as I know the package should never indicate whats in there. I had a few show up with the barrel sticking out the end of the package...didn't make much difference how THOSE were marked! Nice to jear you could write your own ticket...wish I worked for you!

    just to note that with 01 & 03 ffl's (at least) you can have a different 'premises' address and 'shipping' address.

    It is internet myth that you can only ship to the premises address on the FFL:

    ATF Industry Circular 74-13 outlines
    "Guidelines for Verifying Identity and

    part, that "when the shipment is to be made
    to an address other than the transferee's
    premises as listed on his or her license or on
    his or her certified list, it is suggested that
    the transferor verify the address as being
    that of the transferee." Furthermore,
    pursuant to section 922 (b) of the GCA, it is
    unlawful to ship a firearm interstate to an
    unlicensed individual.

    We encourage that FFLs verify to the best of
    their ability that the shipping address is a
    valid location where the licensee is prepared
    to receive and subsequently possess the
    firearms. In addition, if an FFL has customers
    that require frequent delivery of firearms to
    an address other than their licensed business
    premises, we recommend that the shipping
    address be placed on file with ATF's Federal
    Firearms Licensing Center (FFLC) as an
    additional mailing address.

    It should be noted that any FFL receiving
    firearms at locations other than their
    licensed premises must maintain accurate
    records of acquisition and disposition of
    firearms. The acquisition of firearms must be
    recorded by the close of the following
    business day or, if commercial records are
    maintained, within 7 days following the
    acquisition (See 27 CFR 478.125(e) and (g)).
    In the event of an ATF compliance
    inspection, the FFL must make all records
    and firearms inventory available for
    inspection. In addition, if the location is
    used as a continuous off-site storage facility,
    the FFL must notify the FFLC so that the
    address can be placed on file.
