Selling a rifle from a private party is not illegal in CA so long as you are sending the rifle TO an FFL dealer or if it's an bonafide antique then it can go the buyer directly--and as long as it isn't a by CA definitions what they call an Assault Rifle(their term not mine) and no more than 10 round magazines can be shipped. The no selling to CA deal is mainly from FFL's who have to fill out paperwork to ship handguns to CA--it does not affect private party sales except for the "Assault rifle" & magazine capacity. BUT some people don't want to deal with CA at all and that is totally their right to do so. If you're just selling some bolt action/lever/pump/single shot rifle you can sell to CA people if YOU wish to--if it's a semi auto then you have to follow CA rules if you decide you want to sell there. Be aware SOME CA FFL's will not accept guns from non FFL's eventhough it's legal to, they just won't--you need to state in your auction that the buyer needs to make sure his FFL will receive the gun from you or add a fee if you have to ship via your FFL to his FFL.

This is true of some FFL's in every state, not just CA.

Another question of-use to a new seller: say we are selling a 50+ year old rifle or pistol, and a buyer says he wishes it to be shipped directly to his house, using a Curio and Relic license. Where do we go to check if that license is valid? I see where we can go check if someone has a valid Federal Firearm License (https://www.atfonline.gov/fflezcheck/) but where can we check the validity of a Curio and Relic license?

Good question ~ that's what I was wondering, too.

I called the ATF office in Indianapolis and they said that I could call them & verify a C&R. Still not absolute, but checking with the ATF does lend peace of mind to it.

Thanks for the feedback. It's all good advice.

I listed my first rifle today and didn't realize how much I don't know untill people started asking questions. I am a casual kind of shooter. I like the character & history, but am not an expert of anything.

I'm taking the rifle to a gunsmith to get an accurate report so that I can answer questions with certainty. Should have done this before listing. Next time I'll be that much more ready.

    Thanks again guys!

    You didn't post a link [:D]

Good auction, you should do well.

Make sure you add in your auction. "I am not an FFL, please verify your FFL will do the transfer"

Good call, Shoff14, I have a C&R, but the issue remains and needs to be made on the post. When I amend the posting I'll add that as well.

I am hopefully going to have this rifle evaluated on Monday at a small gunsmith/gun shop an hour south of my place. It's only open from 10am - 4pm. Pretty much in the middle of no where.... I love those places!!

Figured if this auction goes well, I'd sell a few more. So I will bring my M1 caribne and a few others for estimates as well. If it doesn't cost too much.

There is no point in taking your guns to a gun shop for an estimate. Putting your gun up for an absolute auction means that you don't need an estimate; you list a gun for the lowest price you would consider accepting, & let the free market establish the true value. When my local gun shop owner wants to know the value of a gun, he does a SmartSearch of Gunbroker completed auctions, the same thing you could do, for free.

If you are really anxious to spend your money, go to a camera store & buy a decent camera; ALL OF YOUR PICTURES ARE OUT OF FOCUS. You won't get top dollar if your photos aren't in focus, well lit, & close enough that the markings on the gun can be read.

You might want to take some time to look over auction posted by others. The next time, you may want to include a description of the gun. Part of a description might be "bore is bright & shiny, no rust or pitting"; on the other hand "my safe is getting full" IS NOT DESCRIPTIVE.
