    Alright, I have a rifle up for auction that is C&R Eligbile, that?s all I know (it?s also a rifle btw). I do not have a C&R or FFL. If the bidders that wins has a C&R do I just ship it to them without having to send the rifle through an FFL dealer or what?

    No, only complete firearms are considered to be Curio and Relics. A bare frame/receiver is a firearm and must be shipped to an FFL dealer.

    No. Only complete firearms in original configuration can be considered C&R's.

    Any receiver must go to an FFL.

    A luger can be a little difficult to classify, as it has an upper receiver & a grip frame. Only the grip frame has the complete serial number (which includes the suffix), so that is the part that is considered "the receiver".

    Depending on it age. Original kraut lugers are no problem as they are all over 50 years old. There were Mauser made lugers in the 70's and U.S. stainless made lugers in the 90's, though.

    If a frame is legality transferable to a C & R licensee, ( I don't know ), it would be one of the earlier German made ones.

    We have coverd this one so many times...endlessy going over the same ground.

    ATF Ruling 85-10, which discusses the importation of military C&R firearms, notes that they must be in original configuration and adds that a receiver is not a C&R item. Combining this ruling and the definition of C&R firearms, the Firearms Technology Branch (FTB) has concluded that a firearm must be in its original condition to be considered a C&R weapon. Original configuration does not include a stripped receiver, it has to be a complete firearm to qualify as a Curio and Relic.

    In addition to the above, some states restrict the C & R license. CA prohibits delivery of handguns to C & R holders; and C & R long guns are allowed direct delivery to a Type 03 only if also greater than 50 years old. I presume a few other states like NY & NJ have restrictions also.

    Can't see BATF's rationale in this instance.
    According to them the Mauser rifle, 1911 or Luger pistol..... is C&R eligible but in taking it apart, the frame which is the gun according to BATF definition, loses C&R eligibility by fiat not by reason or logic.
    However, taking a gun apart does not alter it.
    They need to clean up the consistency of their definitions.

    You expect a government enity to make sense? Your are right in that it makes no sense but they make the rules.

    Their stated rationale is: No one collects gun parts.

    Some folks accumulate them, but I've never seen a display of parts at a gun show. So, I think that it makes sense.
