FFL won't transfer gun to my buyer

Every dealer has their own policies. I will not accept firearms from a dealer without a copy of their FFL...and that goes from my wholesalers as well. We will accept firearms from a private party with a copy of their Driver's License. If you are a private party, try contacting the dealer and asking if he will accept a copy of your DL. That should be more than adequate, as it is more than federal law requires.

Thank you for the very concise answer.

It is possible that his STATE has laws that require him to receive guns only from an FFL. I shipped a gun to a buyer in Illinois and his FFL would accept deliveries only from an FFL. He claimed it was the law there. I didn't bother to confirm. I just used a local FFL to ship to him to avoid the dispute. Federal law doesn't require the shipper to be an FFL. That doesn't prevent stricter B.S. state laws.

Eric is correct, you do not need an FFL to ship a gun that you own.

However, you need to tread lightly; yes, he was rude to threaten you, but.....if you shipped a handgun by USPS (rather than by UPS or Fedex) that was a violation of Federal law.

You failed to give us the full story, so there's really not much we can do to help you.

I did ship USPS...perhaps that is the issue. I have emailed him back politely requesting if my DL will do.[:I]

Had the same problem a number of years ago. Would not accept a copy of my drivers license and a copy of my CCW. Even though his state did not require delivery from an FFL. His concern was forged or stolen ID as he could not verify the photo. With the FFL you can check through the ATF online. In that case you filnd an FFL that will accept the transfer or go the extra mile and pay an FFL to ship it for you.

A similar thing happened to me years ago, when I was still doing the auctions. Got a angry phone call from a pawn shop in MS. Guy wanted to know who the h**l I was, and why I had shipped him a pistol. Explained that I received his FFL from from a bidder on the auction.

Problem is some of these guys who bid on your stuff aren't being honest with the 01 FFL's, who are supposed to receive the guns. They tell them some C & B story to get a copy of their FFL.

To not have to be hassled over this, note in your auction specifically that your not a 01 FFL and if they want the gun to be shipped through a FFL they are going to have to pay his S & H fees.

As far as your problem is concerned. I wouldn't sweat it. As long as you have been payed for the revolver, let the guy who bought it come up with a solution to the problem. As far as the FFL and his threats, ignore him, he don't know what he's talking about.

Just read your post about shipping the revolver through the USPS. That's a big NO NO. The FFL ain't kidding, he can get you into really big trouble over this. I would do any thing reasonable to placate him over this. If he was to contact either the BATF or the PO over this, really bad stuff could happen to you.

There's your real answer. You violated Federal Law by being a non ffl shipping a handgun via the US Post Office instead of UPS or FedEx. Non FFL's can only ship long guns and antiques through the US Mail. You might want to be cautious--see if he will ship it back to you at your cost--then ship it the right way.

    Utter nonsense.

Some of you Deputy Dawgs need to go do some research and find out...wait...find me ONE person doing time for unknowingly violating the law by mailing a handgun to a dealer.

The dealer is being a paranoid [edited for content] and could've just said "Hey, Mac, in the future, take any handguns to your local FFL and have him mail them."

Instead he's being a jerk, and acting like the OP sent him an unregistered MG or something.

OP, yeah you messed up a bit, but you didn't do it on purpose, and you should've asked here first...and waited til I responded so I could give you the tinfoil and sanctimony-free answer.

You have been advised before to leave that attitude of yours at the door when you post over in this forum. This is not General Discussion. Your contributions in this forum are worthwhile but they are not invaluable by any stretch of the imagination.

These forums are read by many, many 'behind the scenes' people.

Some of which would love to inform the world that there are postings of legal innaccuracies on Gunbroker!

We're in a fishbowl, here, fellas! Make no bones about it!

    Best, Joe
