Purchasing a Rifle

I was told by the seller that if I purchased a Rifle from him he could ship it out of state to me personally.The seller is not a licensed fire arms dealer.I was under the impression that both he and I would have to hold a FFL to do this.He says that because the barrel is 18 inches long this can be done legally.

    This is only true if the rifle is a antique made before 1899, or it's classified by the feds as a Curio and Relic, and you have a federal license as a Curio and Relic collector. If the rifle and you don't meet the above two criteria, what this guy is telling you, is so much horsepuckky.

    One other thing, if you both live in the same State he can ship you the rifle direct.

    This guy either doesn't know what he's talking about, is lying, or both. Sure he "could" ship it to you personally, just that doing so would be a violation of Federal (and likely State) law.

    While there are certain exceptions where you can legally ship a rifle between states (eg to yourself, or to the manufacturer for repair), shipping firearms between unlicensed individuals in different states is most definitely NOT legal.

    State to state shipment is legal IF:

    a. The gun in question is an air rifle, black powder rifle, or gun with a receiver manufactured before 1898, or.

    b. The receiver has an FFL (C&R FFL is OK for C&R guns only).

    Do you know this person? Is this a Gunbroker seller with lots of good feedback?

    If not, there IS the possibility that this is a scammer, who will be glad to take your money, never to be heard from again.

    I didn't want to "go there", but apart from blinding ignorance, there are other possibilities, too:

    a. Seller is a felon, illegal alien, or minor who probably shouldn't be owning the gun to begin with, and doesn't want to create a paper-trail leading back to him.

    b. Gun itself is stolen.

    c. Seller is a gov't agent trying to execute a "sting". (This one is really "black helicopter" crazy, but you never know. . .see here for an example this sort of stupidity: http://mypetjawa.mu.nu/archives/199122.php ).

    Note that in a legitimate sale, it costs the SELLER nothing extra to ship the gun to an FFL instead of an individual. So I don't see why a seller would offer to skirt the law here when there is no advantage to him in doing so.

    Perhaps when the seller said he would personally ship the gun "to you" he meant to your FFL. If THAT is the case, this WOULD be perfectly legal. Just check with your FFL to ensure that he will do transfers from out of state individuals (not all of them will).

    You have been given good advice. The "18 inch barrel" on a rifle means nothing- 16 inches is minimum for rifle, 18 for shotguns. Seller is either misunderstood, a crook, or really dumb. If it were me, would be "Thanks, but no thanks."
