Seller refusing C&R?

I won a MAS 36 a few days ago. It was listed in the Curio & Relic section and is of course C&R. The seller will only ship to a type 1 FFL. Any ideas on how to explain the laws to him?

    It happens all of the time and in fact seems to be #3 in the list of auction irritations (no sales to California is #1). You can explain the laws and regulations to him but that does not in fact mean that he has to ship the rifle to you. There is no punishment for adopting a higher standard for shipping firearms than the regulations call for so if he insists on the rifle going to a Type 01 dealer it is his call. Although it has been said here many times: It is the prerogative of the buyer to find out ahead of time whether or not seller will honor a C&R FFL. If he won't then he cannot be forced to do so.

    You can't force him to sell it to you, but you might ask him why he put it in the C&R section if he wouldn't sell it to a C&R.
    Did the listing have FFL ONLY?

    If he still doesn't see the light, and you don't want the hassle, simply tell him so.

    I have a C & R and am in CA - I always ask first, the difference between the rifle going to me direct and a CA FFL dealer can be about $100.00.

    Assuming there was nothing in his advert indicating he would do anything other than mail to an FFL dealer, you can show him the C & R regs and your C & R license but I would say that's about it - other than cash. Find out the difference bewteen you getting it direct or going through an FFL - offer him 1/2 that amount.

    I personally will not buy from a seller who will not accept a C&R license on a C&R gun, especially if he posts his auction in the C&R section.

    Before bidding, I always check will the seller to make sure he accepts a C&R license. If he says no, then I politely inform him that he lost my business because of his policy.

    C&R IS a FFL- type 03 FFL.

    And as the folks have said- if he won't, he won't. Unless a seller says DEALER ONLY, or there is a legit concern over whether a given firearm is in fact a C&R- IMHO, refuse to ship, you have refused to complete the sale. He will get a neg feedback, and I will not inconvenience him with my money.

    Well, either he knows what a C&R FFL is or he doesn't.

    If he really isn't familiar with the license, you could explain to him what it is and what its for, or give him a link to various websites he can look at.

    But if he doesn't know what a C&R is for, one wonders why exactly he listed the gun as a C&R. . .

    If he still doesn't want to ship the gun to you, see above.

    You either pass on the sale, or you find a dealer who will do it for you. If it were me, I'd pass.

    Four months down the line (why these threads get dragged back up after such a long time I can never understand) I'd be interested to learn if the OP, colt601, ever got his Mas 36

    Yes I got it but had to go through a dealer and pay the fee. There was no explaining it to him. He said since it was a working gun it was not C&R! I could have passed but it was just more annoying than anything.

    So the guy you were dealing with thinks the only way a gun can be a C&R is to be broken or incomplete? Wow, what a dope. I would have passed and dealt with someone with a complete brain.

    I am also very happy that you got your MAS and hopefully that dealer will become more aware of the rules about shipping Curio and Relic firearms. He is losing a LOT of sales by not honoring a C&R.
