Laws on felons & firearms - Part II

BATFE has a detailed procedure for processing federal pardons for felons who were convicted of nonviolent crimes, & have been clean for 10 years.

HOWEVER, Bill Clinton (actually, Al Gore) ordered ATF not to process any more requests for pardons. No president since then has seen fit to counter this order, & federal bureaucrats don't change any policy without a direct order. So, unless your wife donates at least $100K to the Dems, you aren't getting a pardon anytime soon.

The only remaining way to get a pardon for past crimes is from your state governor. For many of us, that may not be possible.

    You can get an offense expunged, Neal, and it accomplishes the same end result. These are typically reserved for non-violent felonies, however, and IIRC are processed within the jurisdiction where the offense was prosecuted. Different states may vary, I suppose.

    "Pardon" and having record "expunged" are legal terms and how to get it accomplished will vary from state to state. Consult a lawyer. Legal advice obtained on "gun experts" forum is usually worthless.

    Disclaimer- I am not a lawyer- never passed the bar (or passed ANY bar if I could stop)

    Bear in mind there are offenses against a STATE- where the Governor of the state- or his designated rep- may grant a pardon, or relief of disability of not possessing a gun- process varies GREATLY state to state. In every one I know of, you will have completed ALL parole, supervision, have good reports from PO, etc etc etc, BEFORE Governor will consider.

    Then there are offenses againt the Federal Govt. And while there IS a process to seek relief from the Feds, they are prohibited from expending any funds to do that. And a state Governor cannot issue a pardon for a Federal crime.
