Shipping pistols

Is there any difference in the law for shipping a pistol rather
than a rifle to a buyer. I know how to ship a rifle to FFL dealer.

    What are the ATF Federal Laws requiring some one to ship a pistol? I have been hearing USPS will do it, It doesn't have to go next day or air just ship ground. I also understand FedEx, UPS will ship but only next day.. Also, can I collect my FFL transfer fees from the buyer if stated in the auction description?

    Only dealers can ship pistols thru USPS.

    Transfer fee is usually paid to the dealer that receives the item and transfers it to the buyer... why would you collect the transfer fees?

    The pistol is on our license and we have to transfer to the FFL dealer our cost is $40.00 to do this. I was wondering if it is normal that the buyer pays this fee. I know that only dealers can ship, but my FFL dealer claims the law is UPS over night only is this a Federal Law to ship over night or just how he chooses to ship?

    Overnight is FedEx and UPS regs.
    Not law.
    FFL can ship for $13 via USPS.

    You can have YOUR FFL ship a handgun via the Post Office and since he will charge you a fee for that you can charge that to the winner of the auction if you stated that in it. UPS/Fedex will only ship a handgun next day air(their policy)-just make sure you ship from an actual hub and not a UPS Store or Authorized Ship Center or Fedex/Kinkos as they will not ship firearms or ammo. As long as the FFL that you are shipping TO allows a private party to ship a gun to him that's an easy way to do it. You can only ship long guns via the post office--handguns can only be shipped via the post office by FFL's.

    Could just be your FFL doesn't want to use the Post Office--I've known FFL's who were a PITA to deal with when it came to doing transfers but there are plenty of them out there that will do it reasonably.

    I also see you are in NY so that's possibly why you have a different set of rules--I don't know if NY requires you to use a FFL to ship OUT of state or not or in state to a FFL.

    It is not a federal law, or a law of any kind, it is UPS policy and they can set their own rules. EVERYONE using UPS has to abide by their handgun shipping policy; there is no exception for dealers and no option to use ground shipping for anyone.

    Since you are a dealer you have two options: Use UPS and pay their rate or use the Post Office and save some money. There are very few handguns which will not fit into a medium sized flat rate box, which ships for $13. It is as simple as that.

    A nonlicensee may not transfer a firearm to a non-licensed resident of another State. A nonlicensee may mail a shotgun or rifle to a resident of his or her own State or to a licensee in any State. The Postal Service recommends that long guns be sent by registered mail and that no marking of any kind which would indicate the nature of the contents be placed on the outside of any parcel containing firearms. Handguns are not mailable. A common or contract carrier must be used to ship a handgun.

    Q: May a nonlicensee ship a firearm by common or contract carrier?
    A nonlicensee may ship a firearm by a common or contract carrier to a resident of his or her own State or to a licensee in any State. A common or contract carrier must be used to ship a handgun. In addition, Federal law requires that the carrier be notified that the shipment contains a firearm and prohibits common or contract carriers from requiring or causing any label to be placed on any package indicating that it contains a firearm.
