Shipping a gun
Sorry I couldn't find a sticky on this , I sent a shotgun to a gunsmith. It has been registered in my name. I live in MA he is out of state. Can he send my gun to me or does he have to send it to my FFL.

I was told by someone that there is an exemption for repairs and returns. Does anyone know? 0 -

Obviously, it's okay with the USPS, as long as the package is properly addressed.
But, if you reside in a state that prohibits such, does the USPS refuse to ship it?
I'd be curious to know the states that prohibit such.
Well, here's an example: Blackpowder firearms are exempt from both USPS and BATF regulations, right? However, if you ship one to an individual in New Jersey, you're in violation of state law. If you ship one to NY City, you violate a city ordinance. In both cases, they must go through an FFL dealer.0 -
Covered in Fed law under 18 USC 922. A licensee may recieve, and may return firearm, or LIKE firearm to original owner. You CANNOT MAIL a handgun by US Mail unless you are an 01 Dealer FFL or a Manufacturer. And NO, it is NOT OK with the Post Office. It violates Chapter 14, Restricted mailings. Even us 03 C&R FFLs cannot MAIL a handgun. Ship, yes, mail, no. But the OP asked about a SHOTGUN- and LONG GUNS can be mailed legally.
C&P from 18 USC 922:
Sec. 922. Unlawful acts
(a) It shall be unlawful--
(1) for any person--
(A) except a licensed importer, licensed manufacturer, or
licensed dealer, to engage in the business of importing,
manufacturing, or dealing in firearms, or in the course of such
business to ship, transport, or receive any firearm in
interstate or foreign commerce; or
(B) except a licensed importer or licensed manufacturer, to
engage in the business of importing or manufacturing ammunition,
or in the course of such business, to ship, transport, or
receive any ammunition in interstate or foreign commerce;
(2) for any importer, manufacturer, dealer, or collector
licensed under the provisions of this chapter to ship or transport
in interstate or foreign commerce any firearm to any person other
than a licensed importer, licensed manufacturer, licensed dealer, or
licensed collector, except that--
(A) this paragraph and subsection (b)(3) shall not be held
to preclude a licensed importer, licensed manufacturer, licensed
dealer, or licensed collector from returning a firearm or
replacement firearm of the same kind and type to a person from
whom it was received; and this paragraph shall not be held to
preclude an individual from mailing a firearm owned in
compliance with Federal, State, and local law to a licensed
importer, licensed manufacturer, licensed dealer, or licensed

Massachusetts state law is the one that is going to be the determining factor. The feds will allow the direct return shipment, but that in no way allows anyone to circumvent a state firearms law if the state law does in fact prohibits it. Just ask the FFL on the receiving end what he plans to do about returning the firearm to you and do it. It is his license on the line so he will do whatever is safe. 0
