transfer to type 03 FFL
I see this as a shipping question. Have there bean restrictions on shipping and transfer to type 03 FFL from state to state in the last three years.
As my previous post has been locked with no answer. The only answer I received is this is not the place to discuss auctions. I do not see this, or my other post as an auction post.

No,,but with that said alot of 01 ffl's will not honor a C&R. Its their choice as it is also thier choice not to ship to California or anywhere else they chose not to..It is they who may miss a sale but they are willing to do so..I have held a C&R for almost 15yrs and I always ask the seller if he will take it. If they say no I just will not bid 0 -

I was beginning to think I had mised something as I am seeing a lot of seller restrictions recently. I live in a gun friendly state in the mid west.
With the economy I have been considering thinning out some of the duplicates in my collection and did not wont to get my self in trouble.
So I can still transfer any C&R firearm to any 01or 03 ffl license in any state or municipality?0 -
01, yes. 03, depends.
Some states/localities restrict what guns (mainly handguns) an 03 can receive. But, figuring out the restrictions of another state is just about impossible. I do know that CA recognizes a C&R only for firearms > 50 years old. And, I won't ship anything to an 03 in IL because of all the local restrictions.
But, no one has ever been prosecuted for shipping a C&R to a C&R licensee.

EDIT: Gary, a dealer (& any other business owner) must meet the requirements of the state/locality within the state where he is located. Licenses, tax collection, zoning, etc are part of doing business. This is a Constitutional issue, designed to ensure that the states have sovereignty within their borders. The Gun Control Act of 1968, which affects most gun laws within every state, would probably be thrown out by a conservative Supreme Court; it's only basis is the Interstate Commerce clause of the Constitution. FYI, GCA 68 makes it illegal for someone to violate a firearms law within any other state, which one would think violates the Constitution.
Lots of folks sell & ship firearms to 01's & 03's on the GB auction without any problem; just follow the few simple rules detailed in the FOR SELLERS tutorial.0 -

There are no private sales allowed on this forum, in fact offers to buy or sell are deleted aggressively. Since there are no private sales then the use of the word seller can only apply to sellers on the auction side and we do not handle auction issues of any sort here in the forums. If you have a question about shipping firearms then ask but don't play games with me. No, state laws and local regulations will always take precedence over federal laws so if a state does not recognize the Type 03 FFL then you may not ship to that state. This also applies to the many state which have their own dealer licensing program, like CA: A person who holds a Type 01 FFL but does not hold the necessary state issued dealers license is not considered to be a legitimate dealer so you cannot ship to him.0 -
Well I see I am probably not PC enough for this sight.
I was doing research in hops of possibly liquidating some of my collection. I see all sorts of restrictions on shipping to 03ffl's. So I start asking questions.
I was not intending on trolling I didn't know the word s*ll*r was forbidden. I did not intend on playing games with you Mark or any one else.
Interesting I didn't know it was possible to have a FFL and not first satisfy State and local ordinances.

When you get the Type 01 FFL before you ship run the number through the ATF EZ Check website. If the license is valid it will say so but if it has been rescinded for various reasons, which include no longer complying with state and local regs, the EZ Check will indicate it. Type 03 Curio and Relics FFLs cannot be verified on line but you can call the ATF licensing center in Atlanta and ask if the FFL is valid. C&R FFLs allow the holders to ship and receiver various classes of firearms considered desirable to collectors through interstate commerce but that license does not supersede any state laws which wold otherwise restrict the transfer of firearms inside teh state where it was issued unless these are specifically outlined in the state's firearms regulations. Keep in mind that many dealers will refuse to accept firearms shipments from anyone unless they hold a valid Type 01 FFL so before shipping be sure that this issue is understood by both parties nor do they recognize a Type 03 FFL for Curio and Relics. You have no recourse of the dealer on the receiving end insists on all firearms being shipped to him from another FFL dealer. 0 -
Now you understand why folks are reluctant to ship to Cali, or 03's in other States. It's not worth the hassle.
If your fixing to sell your stuff? As long as it goes to the address on the 01's license, not likely you will have any problems. Except with the jokers who don't want to send you a copy of their license, just it's number. If that happens I would just walk away from the deal.0 -
In New York State (except NY City where everything must go to a Type 01 dealer), you can ship a C&R logarm directly to a C&R licensee but C&R handguns must go TO a Type 01 FFL dealer and sent FROM a Type 01 FFL dealer. 0
