75 round drum mags in NY
A police officer wants to buy a 75 round drum mag. He lives in NY and will furnish his ID with payment. Is it legal for me to ship the item to him?

I don't see any exemption for police officers built into Article 265.00, which defines firearms and various "dangerous items" like high capacity magazine (and let's not start an argument over the use of that term here). Police officers are specifically exempted from a number of statues in 265.00, but no mention is made of peace officers being exempted from 265.00(23), which covers high capacity magazines. I would say that unless you can prove the magazine in question was produced prior to 13 September, 1994 you can not ship it to a police officer in NY State. If he insisted then have him include a letter from his department on official letterhead and signed by his superior (generally a Lt. or higher is acceptable) authorizing the purchase for use in a duty weapon provided by the department or purhcased by him strictly for duty use. I doubt if any PdD's are using Aks as duty firearms but if he can provide the letter demonstrating official use then your a$$ is covered. No department letter means no sale and as far as I am concerned he appears to be buying the drum for his own use and attempting to use his police ID as a means of getting around NY State law. 0 -
It is a Romanian drum. I can't prove it is pre-ban as it isn't marked and I don't won't to try. Thanks for the advice. I won't ship it to him. 0 -
You can always ask him to provide the specific statute which exempts police officers from the restriction on high capacity magazines. 0
