MP 40

I was "willed" my Grandfather's guns after his death about 15 years ago. Many of his guns where brought back home after his service in WWII. One of the guns is an MP40 that I was told was worth several thousand dollars and I was just looking to get any information on this particular gun

    If it was properly registered it is worth a considerable sum. If it was not registered it is contraband and is virtually worthless. Before we go into detail we need you to establish that you have the registration papers in possession.

    I was told he did with the ATF by my grandmother, who is now decreased, and I am trying to find them presently.

    Without the paperwork it has no value and is in fact an engraved invitation to a trip to any of several federal prisons and a hefty fine. If you do have the papers it is worth in excess of $10,000 and there are several manufacturers, some of which have a premium among machine gun collectors. When you have the papers come back here and tell us about the gun.

    Your firearm has to have a legal existence in the country and home state that you reside in. A firearm must have a legitimate presence otherwise it's something that is most likely going to force legal issues for you affecting your good name and well being in life. No firearm is worth that. Because you're in a posting on a website on the internet your correspondence is not private or secure. I hope you find the required documentation so there's no issue.

    Question: Is there a format which could be used to obtain the necessary paperwork after the fact as in an instince where a "bring back trophy" was not properly papered? Thanks for the info.

    I think the last opportunity to legally register such a machine gun was in 1968. If it didn't happen then, it's likely illegal now.

    Fastrat nailed it. You CAN have the BATFE search for registration papers- let me know how that works out for you- their track record in locating their own records is not stellar. The last opportunity to register it would have been the 1968 amnesty. If it was not registered then, it cannot BE registered now. Howrver, IF the gun WAS papered, there are specific provisions for transfer of the gun BY INHERITANCE- no transfer tax. If not papered, the BATFE requires that it be surrendered for destruction. Sorry- and I REALLY mean that. There are a lot of war souvenirs coming out of grandad's closet now days- and no way to retroactively make them legal.
