Mississippi Gun Law Buying Question. Mental??
ok to be blunt my friend is wondering if he can still buy another handgun.
the story is this. he drank a bunch blacked out and cut his wrists and was uncooperative at the hospital. so the doctor on duty had him committed via judge writ in mississippi to a crisis unit and stayed for 10 days and was discharged via the doctors their releasing him/discharging him after their say and the judge signed the papers. this happened months back a year. Keep in mind he still has never had his other guns confiscated and besides cutting himself, is an upstanding citizen who did something stupid in the heat of the momemt. He did his time and was discharged.. please no negative comments. he has owned his guns for many many years as well.
he was discharged(not considered a threat to himself or others) he already owns a few handguns... and has never committed a crime. would this count as a mental problem and would he be prohibited from buying another gun rifle and or handgun in the future??
if not how can he still own his other guns then?
I tried to search but came up with nothing.... keep in mind there was never any arrests made throughout the whole ordeal and has never committed a single crime..
any law gurus much appreciated on this. i tried to search for him..

oops left out, i was told he could buy FTF, Pawnshops and at Gunshows. but could he still buy at places like ACADEMY or DICK's/instant background check/brand new guns??
if not it boggles me then how he is allowed to keep his other guns?

"Committed for evaluation" is not the same thing as being "adjudged insane".
IOW "Send him in for a check up" VS "Not guilty by reason of insanity and ordered to spend the next few years in the nut house".0 -
Best for him to stay under the radar and keep what he's got and wait a while. Understand his own state and federal laws... 0 -
I believe that the paragraph in question, contained in the Gun Control Act of 1968 (see ATF P5300.4) is:
"...has been adjudicated as a mental defective or who has been committed to a mental institution"
Federal & local law enforcement have been aware for several years that NICS & many state data bases are not effective at identifying those with mental history due to the fact that few of these records have been computerized. This is because of the preceived need to keep this information confidential, plus many states just don't have the money to set up the computer systems. However, the federal government has been giving money to the states in order for them to make this conversion, so it is only a matter of time before that happens.
I am not a lawyer, I am not a legal guru, & I would never give legal advice to your friend. But, as a layman who hates prison food, I would advise your friend to pay his own attorney to research, in confidence, his past & how that applies to his ability to possess firearms.
